Kühn's legal representation has released the resolution in which the Supreme Court
rejects the Autonomous Community's appeal,
along with a statement in which it details that the sentence establishes
payment with public money of 63.5 million euros
plus interest. accrued since May 2009, date of the first claim following the inclusion of Muleta in a
law for the protection of natural spaces
during the second left-wing Government.
These interests amount to 32.5 million
euros, so the total amount that the Government must pay as compensation is
96 million euros.
"The ruling reviews the
very long judicial process
of this conflict, which began in 2010 and now ends
14 years later
," recalls the German businessman's defense, which highlights that in 2013 a court
ruled in favor of the urban character
of the land, which were protected again by another autonomous law in 2017, in the third legislature of the left-wing Government.
As this rule made it impossible for the Muleta lands to be incorporated into the General Urban Development Plan of Sóller, Kühn
claimed compensation,
which is what the Supreme Court has just established.
"The ruling handed down bases its reasoning on this
impossibility of reincorporating
Muleta as urban land to the PGOU of Sóller, confirming that the payment of compensation was appropriate by making the development of this land, which
had previously been recognized as urban
in the order, impossible.
