Burkina Faso: justice orders the release of lawyer Guy-Hervé Kam

In Burkina Faso, the justice system has just ordered, this Thursday, March 7, the immediate release of lawyer Guy-Hervé Kam.

Arrested by men in civilian clothes on January 24 at Ouagadougou airport, it was only this week that the state's judicial agent announced that the lawyer and politician was being prosecuted in a "

', for trying to mobilize students and traditional leaders. 

On Thursday March 7, the courts ordered the immediate release of Maître Guy-Hervé Kam, Burkinabè lawyer and human rights activist.

According to his lawyers, the arrest of Maître Guy-Hervé Kam had not respected any procedure.

And according to the judge of the administrative court, his detention violates the fundamental freedom of the lawyer.

Since January 24, the co-founder of Balai Citoyen

has been kept in solitary confinement

without his lawyers being able to visit him.

They say they are satisfied with this decision, motivated by “

law

”, according to Maître Prosper Farama.

What is being asked for Guy-Hervé Kam is not impunity but respect for his rights

Guy-Hervé Kam's defense emphasizes that if

the Burkinabe state

has something to reproach his client for, "

these accusations must be carried out in a normal procedure, which respects the standards provided for by our texts

 ".

Court decisions not always implemented

It is unclear whether the State intends to appeal this decision, or to comply with the judgment and release the

leader of the Sens political movement

.

Recent experience shows that in Burkina Faso, court decisions are not always applied.

Last November, the same court ordered the release of businessman Anselme Kambou, without effect.

In December, the same court invalidated the military requisitions of Rasmané Zinaba and Bassirou Badjjo of Balais Citoyen, which did not prevent these two men from being arrested last February, according to a typical operating procedure, which recalls the way in which some Burkinabés are forcibly conscripted into the army.
