On February 15, Juan Alfonso RP (52 years old), a nursing assistant at the Fundación Instituto San José Hospital, went to work for the last time on the afternoon shift.

At 5:30 p.m., without prior warning, a patient put his hands on his shoulders and kicked him

hard in the testicles

.

Despite working in a hospital,

he never saw a doctor and he died hours after

the incident.

This is stated in a

complaint filed by the CCOO union to the Labor Inspection

.

Some events in which, according to union sources, "the aggression protocols were not applied in the work environment, nor were the appropriate preventive measures adopted despite the fact that the prevention delegates had repeatedly requested it."

The victim worked as a care assistant in the San Nicolás pavilion of the aforementioned San José Institute Foundation Hospital,

a private center managed by the religious order of San Juan de Dios

.

A wing of the medical center in which healthcare professionals must deal with patients suffering from serious mental problems.

According to the reported facts, at half past five in the afternoon,

the psychiatric patient placed his hands on Juan's shoulders and, while both remained standing, he kicked him hard in the testicles without warning

.

As a result of the impact, "

the worker fell to the ground sideways, lost consciousness and remained pale

and unconscious for a few moments" until he regained his senses, according to the union.

The worker was then taken to the infirmary, where he was treated by a nurse.

However, despite being in a hospital,

at no time was he inspected or treated by a doctor

.

"He never saw a doctor," they point out from CCOO.

After leaving him to rest for an hour and a half in the infirmary, those in charge of the San José Institute Foundation

informed Juan that he could go home and provided him with an assistance report so that he could go to the mutual insurance company

, since an attack in the area of work constitutes, in legal terms, a work accident.

Given the time at which he was allowed to leave, CCOO points out that the worker

was not able to approach the mutual doctor on the same day he suffered the attack

and Juan died hours after receiving the kick in the testicles that same night.

From the union, they insist that

they had warned the hospital management that "a protocol for physical attacks was necessary

, especially among workers who must deal with psychiatric patients."

Some warnings that they claim that the San José Institute Foundation Hospital "had always ignored."

Likewise,

CCOO has denounced the existence of "corporate responsibility"

by understanding that there is "a direct relationship between injuries and the work environment."

In addition to the complaint filed with the Labor Inspection, the family of the deceased worker and the union are studying demanding civil and criminal liability from those responsible for this center owned by the religious order of San Juan de Dios.

Meanwhile, the family and the union await the ruling of the forensic report.
