Türkiye: the standoff around the presidential regime continues

New episode in Turkey of the standoff between the Constitutional Court and President Erdogan.

In a judgment dating from last fall, but the content of which was only published on Tuesday in the Official Journal, the high court annuls 37 provisions of a symbolic text: the first decree-law signed by Recep Tayyip Erdogan after the entry into force of his hyper-presidential regime in July 2018. The Court was seized by the opposition, which welcomes this decision.

On the opposition side, we applaud a “ 

blow

 ” to Recep Tayyip Erdogan and his regime, but we believe that this decision does not bode well for the Constitutional Court and its members.

“ 

Mr Erdogan will consider them first as traitors, then as terrorists

 ,” predicts Mustafa Yeneroglu, deputy of the Deva party, formerly close to the head of state.

In its judgment, the Court considers that certain powers granted to the Presidency of the Republic and to ministries violate the Constitution, or that it would have been necessary to go through the law – that is to say, through Parliament – ​​for to have adopted.

For example, the one that allows the presidency to employ judges and prosecutors for three years.

Or the one, also canceled, which authorizes him to “ 

collect information

 ” on senior officials.

Yet another, which entrusts the Ministry of Urban Planning with powers normally devolved to town halls.

For Recep Tayyip Erdogan, this is a new snub for the Constitutional Court – the only institution that can still claim a certain independence.

The president castigated some of his recent decisions – notably the one demanding the release of political prisoner Can Atalay – and called for reform of the highest court.
