Indiscriminate insults, rumors and slander, invasion of privacy and other "button-pressing" behaviors on the Internet have seriously infringed on the personality rights of others and seriously disrupted the Internet. order, seriously affecting the public's sense of security.

  In order to punish cyberviolent crimes in accordance with the law and effectively safeguard citizens' personal rights and interests and online order, the procuratorial organs proactively perform their duties in accordance with the law and have adopted a series of measures: First, accurately apply public prosecution procedures and effectively punish crimes of online insult and defamation.

Different from traditional illegal crimes, cyber violence information spreads widely, causes great harm to society, and is difficult to eliminate. The public opinion storm may cause victims to endure great mental pressure and pain, and some may cause "social death" or even serious consequences such as mental disorder and suicide. However, it is often difficult for victims to obtain rights relief through private prosecution due to difficulty in producing evidence and safeguarding their rights.

In this regard, the procuratorial organs have actively adapted to the people's higher demand for criminal protection of personal dignity in cyberspace in the new era. For online insult and defamation crimes that seriously endanger social order and national interests, they are in compliance with Article 246, Paragraph 2, of the Criminal Law. Where stipulated, public prosecution procedures shall be applied in accordance with the law.

The procuratorial organs insist on severely punishing crimes that infringe on citizens' personal information in accordance with the law, focusing on cracking down on the entire chain from the source of theft to the end of sale, and strengthening the protection of citizens' credit information, biometric information, whereabouts information, health and physiological information and other personal information.

Focus on the problem of "insiders" leaking citizens' personal information in the fields of finance, telecommunications, real estate, hotels, labor agencies and other fields, and promote source control through the issuance of procuratorial recommendations.

From January to November 2023, the procuratorial organs prosecuted more than 7,300 people for crimes involving infringement of citizens' personal information in accordance with the law, in an effort to improve the people's sense of security in cyberspace.

In recent years, the Supreme People's Procuratorate has given full play to its advantages in prosecutorial integration and strictly enforced case quality standards for cyber violence crimes that are widely concerned by the society. It has supervised and guided a number of Internet crimes with significant impact, such as the case of a woman who was defamed while picking up express delivery in Hangzhou and the case of "Old Man and Young Wife" in Dongguan. Since 2022, the Supreme People's Procuratorate has released guiding cases with the theme of "Criminal Protection of Personal Rights in the Internet Era" and typical cases with the theme of procuratorial organs punishing crimes that infringe on citizens' personal information in accordance with the law. At the same time, we continue to work with relevant departments to weave a close legal network. In September 2023, the "Two High Schools and One Ministry" jointly issued the "Guiding Opinions on Punishing Internet Violence Crimes in accordance with the Law", which accurately grasps the conditions for public prosecution of insults and defamation crimes and the legal basis for them. There are clear requirements for the application of public prosecution procedures.
