  On the same day, the Ministry of Human Resources and Social Security of China issued the "Guidelines for the Protection of Rest and Remuneration Rights and Interests of Workers in the New Employment Form", "Guidelines for the Disclosure of Labor Rules for Workers in the New Employment Form" and "Service Guidelines for the Protection of the Rights and Interests of Workers in the New Employment Form". Workers in new forms of employment such as distribution, travel, transportation, and domestic services will be included in the minimum wage guarantee.

  At present, there are about 84 million workers in China’s new employment form.

In reality, there are outstanding problems such as workers in some new employment forms working too long, the application of minimum wage standards is not clear, platform rules are not open and transparent enough, and rights protection service channels need to be further unblocked.

To this end, the Ministry of Human Resources and Social Security has issued the above-mentioned new regulations to guide enterprises to regulate employment and guide workers in new employment forms to safeguard their rights in accordance with the law.

  Among them, the "Guidelines for the Protection of Rest and Labor Remuneration Rights and Interests of Workers in New Employment Forms" proposes methods for calculating working hours and rest methods for workers in new employment forms. It is clear that when workers' working hours reach the upper limit, the system should push a rest reminder and stop Push orders for a certain period of time to ensure that workers get necessary rest time and prevent workers from overworking.

  In terms of "labor remuneration", the guidelines make it clear that the labor remuneration paid by enterprises to workers in new employment forms who work on legal holidays should be higher than the labor remuneration during normal working hours, and the labor remuneration should be paid to new employees in full and on time in the form of currency.
