The PP has filed a complaint before the Criminal Chamber of the

Supreme Court

, against the State Attorney General, Álvaro García Ortiz, for the "arbitrary" appointment "contrary to the report of the

Fiscal Council

" of his predecessor in office and former Minister of Justice,

Dolores Delgado

, as prosecutor of the Togada Prosecutor's Office of the Supreme Court.

In the text of the complaint, the

ones point out that García Ortiz, "based, surely, on promises previously made, proposes Mrs. Dolores Delgado, his former boss, against the criteria of the Fiscal Council, to the condition of Chamber Prosecutor as well as her appointment as Chamber Prosecutor of the Togada Prosecutor's Office of the Supreme Court, a call that," they recall, "had been conceived when Mrs. Delgado was Attorney General of the State."

They also explain that the facts that motivated the complaint were prosecuted in administrative litigation and the ruling concluded that "there was a misuse of power in the proposal made."

The Supreme Court, they add, "could appreciate that Mr. Álvaro García Ortiz's proposal is arbitrary and contrary to the report of the Fiscal Council" and, furthermore, they deduce from this that "the attitude" of the current attorney general of the State "has the appearance of a crime of prevarication, according to article

404

of the

Penal Code

. They also point out that García Ortiz himself knew, when he proposed Delgado, that said appointment lacked legal support and, although the appointment was made by the Council of Ministers, "there is no doubt that García Ortiz's proposal was decisive." .

The appointment of Dolores Delgado was made, according to the PP complaint, "without any argumentative effort, without regulatory support and on the basis of arguments outside the corresponding jurisdiction, based exclusively on her personal obstinacy."

The

popular

ones insist in their complaint that the proposal directed by Álvaro García Ortiz "is an act capable of being classified in itself as constituting the crime of prevarication." And they conclude: "The purpose of the proposal was to pay a debt of gratitude and encourage the former attorney general to rejoin the tax career in the highest category although there is no legal provision for this."
