  • Politics Junts affirms before the Venice Commission that its objective is a "comprehensive and immediate" amnesty

The Judiciary alerts the Venice Commission that the Amnesty Law is causing "an unprecedented deterioration in the rule of law." The members of the Professional Association of the Judiciary, the

Francisco de Vitoria Judicial Association

(AJFV) and

the Independent Judicial Forum

(FJI) have explained this Thursday to the members of the delegation of European experts the tense situation that the amnesty for the leaders of the

process

is causing in our democratic system.

The meeting was also attended by the

Judges for Democracy

association , which considered it premature to rule on a Law that has not yet been approved by the Cortes, indicate sources familiar with the terms in which the meeting that took place this afternoon in the headquarters of the General Council of the Judiciary.

The members of the Commission met first with the president of the Council, Vicente Guilarte, with members José

Antonio Ballestero

and

Mar Cabrejas

later joining the meeting . Sources from the body consulted by EL MUNDO report that the main matter of interest for the members of the delegation was the report that the governing body of the judges has to issue - at the request of the Senate - on the proposed law. In this sense , the

Venice Commission

has been interested in the circumstances surrounding the request for the report and whether it is common for one of the Chambers of Parliament to ask the Council for an opinion on a proposed law. The response has been that it was something exceptional since that the CGPJ normally reports on draft laws but not on proposals.

Regarding the meeting with the judicial associations, which took place in the Plenary Hall, the representatives of the

APM, AJFV, JJpD and FJI spoke in this order.

From the majority APM, the president of the

Superior Court of Justice of Madrid

,

Celso Rodríguez Padrón

, pointed out that the

Amnesty Law

is a Law that lacks technical legal justification and that is being processed as it is a demand from the Catalan separatists to support the investiture of Pedro Sánchez. For her part, from the

AJFV

, its representative

Carmen Gámiz

added that it represents a breach of the principle of equality included in the Constitution when the goal pursued with the amnesty is not a "legitimate goal" that constitutionally protects such an exceptional measure. From the Independent Judicial Forum, its vice president

Victoria Muñoz,

stressed the lack of justification for a Law of these characteristics.

These three groups agreed to warn of their concern about the erasure of the crimes of terrorism and embezzlement of public funds. They stressed that there is no room in European legislation for any differentiation regarding terrorist crimes since they all violate human rights. They also showed their concern about the

lawfare

commissions and the attacks from Parliament on members of the

Judiciary

with names and surnames who have been accused of "prevaricating."

Only

JJpD

stood out, focusing his intervention on criticizing the actions of the Judiciary. Its representative Benjamín Fernández indicated that the CGPJ does not equally defend all judges against attacks from political powers and gave the example of Judge

José Ricardo de Prada.
