Emergency Plan Management Measures

  Chapter 1 General Provisions

  Article 1 In order to strengthen the construction of the emergency plan (hereinafter referred to as the emergency plan) system, standardize the management of the emergency plan, and enhance the pertinence, practicality and operability of the emergency plan, in accordance with the "Emergency Response Law of the People's Republic of China", etc. Laws and administrative regulations formulate these Measures.

  Article 2 The term "emergency plans" as mentioned in these Measures refers to the measures taken by people's governments at all levels and their departments, grassroots organizations, enterprises, institutions and social organizations to respond to emergencies in a legal, rapid, scientific and orderly manner and to minimize emergencies. and the damage it causes.

  Article 3 These Measures shall apply to the planning, preparation, approval, release, filing, training, publicity, drills, evaluation, revision, etc. of emergency plans.

  Article 4 Emergency plan management follows the principles of unified planning, comprehensive coordination, classified guidance, hierarchical responsibility, and dynamic management.

  Article 5 The State Council shall uniformly lead the construction and management of the national emergency response plan system, and local people's governments at or above the county level shall be responsible for leading the construction and management of the emergency response plan system within their respective administrative regions.

  Relevant emergency response departments are responsible for the management of emergency plans in their own departments (industries and fields) within the scope of their respective responsibilities; the emergency management departments of people's governments at or above the county level are responsible for guiding the management of emergency plans and comprehensively coordinating the connection of emergency plans.

  Article 6 The emergency management department of the State Council shall coordinate the management of the emergency plan databases of various regions and departments, and promote the sharing of emergency plan data. Each region and department is responsible for the management of emergency plan data for its own administrative region and department (industry and field).

  People's governments at or above the county level and their relevant departments must focus on the use of information, digital and intelligent technologies, promote innovations in emergency plan management concepts, models, means, methods and other innovations, and give full play to the role of emergency plans in guiding emergency preparedness and guiding response and rescue.

  Chapter 2 Classification and Content

  Article 7 According to the division of formulation entities, emergency plans are divided into two categories: emergency plans of the government and its departments, and emergency plans of units and grassroots organizations.

  The emergency plans of the government and its departments include overall emergency plans, special emergency plans, departmental emergency plans, etc.

  Emergency plans for units and grassroots organizations include emergency plans prepared by enterprises, institutions, village committees, residents' committees, social organizations, etc.

  Article 8 The overall emergency plan is the overall institutional arrangement organized by the people's government to respond to emergencies.

  The overall emergency plan focuses on the entire process before, during and after the emergency, and mainly clarifies the overall requirements for response work, event classification and classification, the composition of the plan system, the organization and command system and responsibilities, as well as risk prevention and control, monitoring and early warning, handling and rescue, emergency response Protection, recovery and reconstruction, plan management, etc.

  Article 9 A special emergency plan is a plan involving the responsibilities of multiple departments formulated in advance by the people's government in response to a certain type or types of emergencies, or for important special tasks such as protection of important targets, support for major activities, and emergency support. .

  Departmental emergency plans are prepared by relevant departments of the people's government in response to emergencies in their departments (industries and fields) based on the overall emergency plans, special emergency plans and departmental responsibilities, or for the protection of important targets, guarantees for major activities, emergency support and other related departmental work.   Article 10 Special and departmental emergency plans for emergency response mainly stipulate the organizational command system and special work arrangements for emergency response work of the people's government at or above the county level or relevant departments. The contents of the plans at different levels have different emphases and involve relevant matters. The tasks of neighboring or relevant local people's governments, departments, and units should be communicated and clarified.

  National-level special and departmental emergency plans focus on clarifying emergency response principles, organizational and command mechanisms, early warning classification and event classification standards, response classification, information reporting requirements, emergency support measures, etc., focusing on standardizing national-level response actions while reflecting policy and instructive.

  Provincial-level special and departmental emergency plans focus on clarifying the organization and command mechanism of emergencies, monitoring and early warning, graded response and response actions, team material support, and the responsibilities of municipal and county-level people's governments. They focus on standardizing response actions at the provincial level and embody guidance. and practicality.

  Municipal and county-level special and departmental emergency plans focus on clarifying the organization and command mechanism of emergencies, risk management and control, monitoring and early warning, information reporting, organizing self-rescue and mutual rescue, emergency response measures, on-site control, team material support, etc., focusing on standardizing the municipal (regional) )-level and county-level response actions, implement relevant tasks, refine work processes, and reflect the main responsibilities, pertinence, and operability of emergency response.

  Article 11 Special and departmental emergency plans that provide communication, transportation, medical rescue, material equipment, energy, funds, news publicity, order maintenance, charity donations, disaster relief and other support functions for emergency response work focus on clear organization and command Mechanism, main tasks, resource layout, resource calling or emergency response procedures, specific measures, etc.

  Special and departmental emergency plans for the protection of important infrastructure, lifeline projects and other important targets focus on clarifying key functions and parts, hidden risks and preventive measures, monitoring and early warning, information reporting, emergency response and emergency recovery, emergency linkage, etc.

  Article 12 The sponsoring or undertaking organization of major events shall organize and prepare emergency plans for major event guarantees based on the actual situation, focusing on clarifying the organizational command system, main tasks, safety risks and preventive measures, emergency linkage, monitoring and early warning, information reporting, emergency response, personnel Evacuation organization and routes, etc.

  Article 13 Adjacent or related local people's governments and their relevant departments may jointly formulate joint emergency plans to respond to regional and river basin emergencies, focusing on clarifying information notification, organizational command system docking, and handling between local people's governments and their departments.   Article 14 Relevant national departments and the people's governments of very large and megacities may formulate catastrophe emergency plans based on the actual risk assessment of the industry (region) and coordinate the response to catastrophes in their own departments (industries, fields) and regions.

  Article 15 The township (subdistrict) emergency response plan focuses on standardizing the response actions at the township (subdistrict) level, focusing on clarifying the dissemination of early warning information, division of tasks, disposal measures, information collection and reporting, on-site management, personnel evacuation and resettlement, etc. of emergencies.

  The village (community) emergency plan focuses on clarifying risk points, emergency response personnel, early warning information dissemination and response, personnel transfer and avoidance, emergency response measures, emergency resource deployment, etc.

  The form, elements and content of township (street) and village (community) emergency plans can be flexibly determined based on actual conditions, strive to be concise and practical, highlight the transfer of personnel for risk avoidance, and reflect the characteristics of early disposal.

  Article 16 The unit's emergency response plan focuses on clarifying the emergency response person, risk monitoring, main tasks, information reporting, early warning and emergency response, emergency disposal measures, personnel evacuation and transfer, emergency resource deployment, etc.

  Large enterprise groups can establish their own emergency plan system based on relevant standards and actual work needs.

  For production and operation units with single safety risks and low hazards, the elements and contents of emergency plans can be simplified based on actual conditions.

  Article 17 Relevant departments, units, etc. involved in the emergency plan may compile an emergency work manual based on actual conditions. The content generally includes emergency response measures, disposal procedures, emergency rescue teams, materials and equipment, liaison personnel and telephone numbers, etc.

  Emergency rescue teams, support forces, etc. should, based on actual conditions, prepare action plans for specific tasks that require participation in emergency response, focusing on clarifying specific contents such as emergency response, command coordination, force formation, action assumptions, comprehensive support, and other relevant measures. .

  Chapter 3 Planning and Preparation

  Article 18 The emergency management department of the State Council shall work with relevant departments to prepare and revise a work plan for emergency response plans and submit them to the State Council for approval before implementation. The emergency management department of the local people's government at or above the county level shall, in conjunction with relevant departments, prepare a work plan for the formulation and revision of the emergency response plan for the administrative area in view of the frequent emergencies and major risks in the administrative area, and submit it to the people's government at the same level for approval before implementation, and Copy to the emergency management department of the people's government at the next higher level.

  Relevant departments of the people's government at or above the county level may formulate emergency response plans for their own departments (industries and fields) based on actual conditions, and send a copy to the emergency management department at the same level. The emergency plan preparation plans of the relevant departments of the local people's governments at or above the county level are also copied to the corresponding departments at the higher level.

  The emergency plan preparation plan shall be adjusted in a timely manner based on the national economic and social development plan and the actual emergency response work.

  Article 19 The overall emergency response plan of the people's government at or above the county level shall be organized and prepared by the emergency management department of the people's government at the same level, and the special emergency response plan shall be organized and prepared by the leading department for emergency response of the relevant categories of the people's government at the same level. Emergency plans for departments of people's governments at or above the county level, and emergency plans for people's governments at the township level, units and grassroots organizations shall be organized and prepared by relevant formulation units.

  Article 20 Emergency plan preparation departments and units shall form an emergency plan preparation working group as needed, and include personnel from relevant departments and units, relevant experts and personnel with experience in emergency response work. The leader of the preparation working group shall be the relevant person in charge of the emergency plan preparation department or unit.

  Article 21 The preparation of emergency response plans shall be based on relevant laws, regulations, rules and standards, closely combined with reality, and based on risk assessment, resource investigation, and case analysis.

  Risk assessment is mainly to identify emergency risks and their possible consequences and secondary (derivative) disaster events, and to evaluate the possible degree of harm and scope of impact.

  The resource survey is mainly to comprehensively investigate the emergency rescue teams, materials and equipment, and sites available to respond to emergencies in the region and unit, as well as the status of emergency resources that can be utilized through transformation, the status of emergency resources that can be requested for assistance in the cooperation area, and the content of important infrastructure. Disaster protection and backup status, as well as the status of emergency resources that can be provided through potential conversion, provide a basis for formulating emergency response measures.   Case analysis is mainly to conduct a review and study of the occurrence and evolution of typical emergencies, their consequences, and their handling and rescue situations.   Article 22 During the process of preparing emergency plans, the government and its relevant departments should listen to opinions extensively, organize expert demonstrations, and make good connections with relevant emergency plans and national defense mobilization implementation plans. If the responsibilities of other units are involved, opinions should be solicited in writing. When necessary, publicly solicit opinions from the public.

  In the process of preparing emergency plans, units and grassroots organizations should solicit opinions from relevant citizens, legal persons or other organizations based on legal and regulatory requirements or actual needs.

  Chapter 4 Approval, Release and Filing

  Article 23 The emergency plan preparation working group or the leading unit shall submit the emergency plan review draft, solicitation of opinions, preparation instructions and other relevant materials to the emergency plan approval unit. If it is necessary to release a simplified version of the emergency plan due to reasons such as confidentiality, the simplified version of the emergency plan should be submitted for review and approval.

  Article 24 The emergency plan review content mainly includes:

  (1) Whether the plan complies with relevant laws, regulations, rules and standards;

  (2) Whether the plan meets the requirements of the higher-level plan and is effectively connected with the relevant plan;

  (3) Whether the framework structure is clear and reasonable, and whether the main content is complete;

  (4) Whether the organizational command system and division of responsibilities are reasonable and clear, whether the emergency response level design is reasonable, and whether the response measures are specific, concise, effective and feasible;

  (5) Whether the opinions of all parties are consistent;

  (6) Other content that needs to be reviewed.

  Article 25 The national overall emergency response plan shall be submitted to the Party Central Committee and the State Council for review and approval in accordance with procedures, and shall be issued in the name of the Party Central Committee and the State Council. The special emergency response plan shall be sent by the department leading the preparation of the plan to the Ministry of Emergency Management for coordination and coordination, and then submitted to the State Council for review and approval, and shall be issued in the name of the General Office of the State Council or the relevant emergency command agency. Department emergency plans are reviewed and decided by department meetings and issued in the name of the department. If they involve the responsibilities of other departments, they can be issued jointly with relevant departments; when necessary, they can be forwarded by the General Office of the State Council.

  The overall emergency response plans of local people's governments at all levels shall be submitted to the party committee and government at the same level for review and approval according to procedures, and shall be issued in the name of the party committee and government at the same level. The special emergency response plan shall be sent to the emergency management department at the same level for coordination according to procedures, submitted to the people's government at the same level for review and approval, and issued in the name of the general office (office) of the people's government at the same level or the relevant emergency command agency. The procedures for the approval and issuance of departmental emergency plans shall be implemented in accordance with the emergency plan management regulations of the people's government at the same level and relevant departments at higher levels.

  Emergency plans for major events and catastrophe emergency plans shall be reviewed and approved by the people's government at the same level or its departments. The review and approval of joint emergency plans across administrative regions shall be determined through consultation by the relevant people's governments or their authorized departments, and shall be managed with reference to special emergency plans or departmental emergency plans.

  The emergency plans of units and grassroots organizations must be signed by the main person in charge of the unit or grassroots organization and issued in the name of the unit or grassroots organization. The approval method is determined according to the regulations of the local people's government and relevant industry management departments and the actual situation.

  Article 26 The emergency plan approval unit shall, within 20 working days after the issuance of the emergency plan, file the official text (including electronic text) and preparation instructions of the emergency plan with the relevant units in accordance with the following provisions and send a copy to the relevant departments:

  (1) The overall emergency response plan of the local people's government at or above the county level shall be reported to the people's government at the next higher level for record, and sent directly to the emergency management department of the people's government at the higher level, with a copy sent to the relevant departments of the people's government at the higher level;

  (2) The special emergency response plan of the local people's government at or above the county level shall be reported to the corresponding leading department of the people's government at the next higher level for record, and a copy shall be sent to the emergency management department and relevant departments of the people's government at the next higher level;

  (3) The departmental emergency plan shall be reported to the people's government at the same level for record, and sent directly to the emergency management department at the same level, with a copy to the relevant departments at the same level;

  (4) The joint emergency plan shall be filed in accordance with the relevant provisions of the special emergency plan or departmental emergency plan according to the area involved, and a copy shall be sent to the emergency management department and relevant departments of the people's government at the higher level or jointly higher level in the region;

  (5) The emergency plan of a central unit that requires joint emergency response with the local people's government shall be reported to the local county-level people's government for record, and a copy shall be sent to the emergency management department and the leading department for emergency response at the same level;

  (6) The township (street) emergency response plan shall be reported to the people's government at the next higher level for record, and sent directly to the emergency management department of the people's government at the next higher level, with a copy to the relevant departments of the people's government at the next higher level. The village (community) emergency plan shall be submitted to the township (subdistrict) for filing;

  (7) The overall emergency plan of the central enterprise group shall be filed with the Ministry of Emergency Management, with a copy sent to the enterprise management agency, industry competent departments, and regulatory authorities; the relevant special emergency plan shall be filed with the national emergency response leading department, with a copy sent to the Emergency Management Department and the enterprise supervisor.   Article 27 The departments under the State Council that perform emergency plan filing and management responsibilities and the provincial people's governments shall establish an emergency plan filing and management system. Relevant departments of local people's governments at or above the county level shall implement relevant regulations and guide and urge relevant units to complete the emergency plan filing work.

  Article 28 The emergency response plan of the government and its departments shall be disclosed to the public within 20 working days after it is officially issued. The emergency plans of units and grassroots organizations should be disclosed to the unit and other units and regions that may be affected within 20 working days after they are officially issued.

  Chapter 5 Training, Publicity and Drills

  Article 29 After the emergency plan is released, the unit that prepares it should do a good job in organizing, implementing and interpreting it, track the implementation of the emergency plan, and understand the opinions and suggestions of relevant parties and the public.

  Article 30 The emergency plan preparation unit shall provide training to management personnel and professional rescue personnel closely related to the implementation of emergency plans by compiling and distributing training materials, holding training classes, and conducting work seminars.

  People's governments at all levels and their relevant departments should regard emergency response plan training as an important part of relevant business training and incorporate it into the daily training content of leading cadres, civil servants, etc.

  Article 31 For non-confidential emergency plans that require extensive public participation, the preparation unit shall make full use of the Internet, radio, television, newspapers and other media to widely publicize, and produce publicity and popularization materials that are easy to understand, easy to remember and use. Distributed free to the public.

  Article 32 The emergency plan preparation unit shall establish an emergency plan drill system and organize drills for the units, personnel, equipment, facilities, etc. involved in the emergency plan through various methods and methods. Problems were discovered and solved through drills, and emergency plans were further revised and improved.

  Special emergency plans and departmental emergency plans should be drilled at least once every three years.

  The people's government of areas prone to natural disasters such as earthquakes, typhoons, storm surges, floods, flash floods, landslides, debris flows, forest and grassland fires, and the operation and management of important infrastructure and lifeline projects such as urban water supply, power supply, gas supply, oil supply, and heat supply. Units, mining, metal smelting, construction units and units producing, operating, using, storing, transporting, and discarding hazardous items such as flammable and explosive items, chemicals, radioactive items, public transportation, public places, hospitals, schools, etc. Business units or management units of crowded places should organize and carry out emergency plan drills in a targeted manner.

  Article 33 The emergency plan drill organizing unit shall strengthen drill evaluation. The main contents include: the execution of the drill, the practicality and operability of the emergency plan, the operation of the command coordination and emergency linkage mechanism, the handling of emergency personnel, the drill The applicability of the equipment used, opinions and suggestions on improving emergency plans, emergency preparations, emergency mechanisms, emergency measures, etc.

  Relevant departments in all regions shall strengthen the evaluation and guidance of emergency plan drills in their own administrative regions and departments (industries and fields). As needed, the emergency management department, together with relevant departments, will evaluate and guide the emergency response plan drills organized by the lower-level people's governments and their relevant departments.

  Encourage third-party professional organizations to conduct emergency plan drills and evaluations.

  Chapter 6 Evaluation and Revision

  Article 34 The emergency plan preparation unit shall establish a regular evaluation system for emergency plans, analyze the pertinence, practicality and operability of the emergency plan contents, and achieve dynamic optimization and scientific and standardized management of emergency plans.

  In principle, the emergency plans of local people's governments at or above the county level and their relevant departments will be evaluated every three years. The evaluation of emergency plans can be entrusted to a third-party professional organization to organize and implement it.

  Article 35 If any of the following circumstances occurs, the emergency plan shall be revised in a timely manner:

  (1) There are major changes in relevant laws, regulations, rules, standards, and relevant provisions in superior plans;

  (2) There are major adjustments to the emergency command organization and its responsibilities;

  (3) The risks faced have changed significantly;

  (4) Significant changes occur in important emergency resources;

  (5) Problems found during actual emergency response and emergency drills require major adjustments;

  (6) Other circumstances that the emergency plan formulation unit deems necessary to revise.

  Article 36 If the revision of the emergency plan involves important contents such as the organizational command system and responsibilities, emergency response procedures, main response measures, emergency classification standards, etc., the revision work shall refer to the preparation, approval, filing, and release of the emergency plan stipulated in these Measures. The program is organized. If only other content is involved, the revision procedure may be simplified appropriately according to the circumstances.

  Article 37 People's governments at all levels and their departments, enterprises and institutions, social organizations, citizens, etc. may submit revision suggestions to the relevant emergency plan preparation units.

  Chapter 7 Safeguard Measures

  Article 38 People's governments at all levels and their relevant departments and relevant units shall designate specialized agencies and personnel to be responsible for relevant specific work, including planning, preparation, approval, release, filing, training, publicity, drills, evaluation, and revision of emergency plans. The necessary funds shall be included in the overall budget arrangement.

  Article 39 Relevant departments of the State Council shall strengthen the guidance and supervision of the emergency plan management work of their own departments (industries and fields), and prepare emergency plan preparation guidelines as necessary. Local people's governments at or above the county level and their relevant departments should strengthen guidance and supervision on the management of emergency plans in their own administrative regions and departments (industries and fields).

  Chapter 8 Supplementary Provisions

  Article 40: Relevant departments of the State Council, local people's governments at all levels and their relevant departments, large enterprise groups, etc. may formulate relevant emergency plan management and implementation measures based on the actual situation.

  Article 41 If laws, regulations, and rules provide otherwise, such provisions shall prevail. Emergency plans that really need to be kept confidential shall be implemented in accordance with relevant provisions.

  Article 42 The emergency management department of the State Council is responsible for interpreting these Measures.

  Article 43 These Measures shall come into effect from the date of issuance.
