  Article 1 In order to regulate off-campus training activities, improve the quality of off-campus training, meet diverse cultural and educational needs, and promote the healthy growth of young people, this document is formulated in accordance with the Education Law, the Compulsory Education Law, the Private Education Promotion Law, the Minors Protection Law and other laws. regulations.

  Article 2 The term “off-campus training” as mentioned in these Regulations refers to organized training outside the school education system and conducted for the society, targeting primary and secondary school students and preschool children aged 3 to 6 years old, with the main purpose of improving academic level or cultivating interests and specialties, etc. or systematic education and training activities.

  Article 3 Off-campus training shall adhere to the leadership of the Communist Party of China.

  Off-campus training implements the national education policy, implements the fundamental task of cultivating people with moral integrity, follows the principle of public welfare, promotes the implementation of quality education, and becomes a useful supplement to school education.

  Article 4 Off-campus training shall be managed in categories according to subject categories and non-discipline categories. The specific classification methods shall be stipulated by the education administration department of the State Council in conjunction with the science and technology, culture, tourism, sports and other departments.

  Article 5 People’s governments at or above the county level shall establish a coordination mechanism for off-campus training to strengthen work coordination.

  The education administration department of the State Council is responsible for the overall planning, comprehensive coordination, macro management and regulation of scale and structure of off-campus training nationwide. The education administrative departments of local people's governments at or above the county level are responsible for off-campus training within their respective administrative regions.

  The departments of science and technology, culture, tourism, and sports of the State Council are the industry authorities responsible for off-campus training in corresponding fields. The science and technology, culture and tourism, sports and other relevant departments of the local people's governments at or above the county level are respectively responsible for the industry management of off-campus training.

  Article 6 To carry out off-campus training activities, one must obtain the corresponding off-campus training license in accordance with the law and meet the conditions of a legal person. Subject-based off-campus training institutions for the compulsory education stage shall be registered as non-profit legal persons.

  The license for off-campus training shall be examined and approved by the education administrative department of the people's government at or above the county level. Using Internet technology to carry out off-campus training activities online shall be subject to the approval of the education administrative department of the provincial people's government. For non-disciplinary off-campus training licenses, before applying for a license from the education administrative department, it must be submitted to the industry authorities at the same level for review and approval. If multiple departments are involved, they must be submitted to the relevant industry authorities for review and approval.

  Article 7 Off-campus training institutions shall have good credit status and organizational structure, employees, funds, venues and facilities, management systems and other conditions that are suitable for the implementation of training activities.

  The name of the off-campus training institution shall indicate the word "training".

  Article 8 Teaching and teaching and research personnel of subject-based off-campus training institutions shall obtain teacher qualifications. Teaching and teaching and research personnel in non-disciplinary training institutions should obtain corresponding professional qualifications.

  In-service teachers and teaching and research personnel in kindergartens, primary and secondary schools are not allowed to engage in off-campus training activities.

  Article 9 Materials used for off-campus training must be reported to the approval authority for record. Among them, those who implement non-disciplinary off-campus training should also submit it to the industry competent department for filing.

  Article 10 Off-campus training shall be arranged outside the teaching hours of primary and secondary schools where the training is located, and shall not occupy national statutory holidays, rest days, and winter and summer vacations to organize compulsory education subject training. The education administrative department of the provincial people's government may, in conjunction with the industry authorities, make specific regulations on the training duration, time period, etc.

  Article 11 Off-campus training institutions shall not organize or participate in the organization of grade examinations and competitions for primary and secondary school students and preschool children aged 3 to 6 years old, and shall not publish the academic results and rankings of training objects.

  Kindergartens, primary and secondary schools are not allowed to use participation in off-campus training or training results as the basis for enrollment.

  Article 12 Off-campus training in subjects for students in the compulsory education stage shall be managed at government-guided prices in accordance with the law, and the provincial people's government shall formulate fee management methods. The fees charged for other off-campus training shall be reported to the examination and approval authority for record.

  Financing and fees collected by off-campus training institutions should be mainly used for training business activities, improving training conditions and ensuring employee benefits.

  Article 13 If an off-campus training institution collects fees in advance, the advance fees shall be included in the supervision. Specific measures shall be formulated by the education administrative department of the provincial people's government in conjunction with relevant departments at the same level.

  Article 14 The education administrative department of the State Council shall work with relevant departments to establish a unified national off-campus training supervision service platform. Off-campus training institutions should fill in and update relevant information in a timely manner to ensure that the information is true and accurate.

  Off-campus training institutions should sign a contract with the training subjects or their guardians, use the standard text of the training contract formulated by the education administration department of the State Council, and register it on the national off-campus training supervision service platform.

  Article 15 The education, science and technology, culture, tourism, sports and other departments of the people's governments at or above the county level shall work with the market supervision departments to improve the joint law enforcement mechanism and strengthen the daily supervision of off-campus training.

  Article 16 The education administrative department, industry authorities and other relevant departments shall carry out off-campus training law enforcement in accordance with the law. During the investigation process, they may take inspection, inquiry, review or copy of relevant materials, advance registration and preservation, and other measures prescribed by laws and regulations. .

  Article 17 Anyone who violates these Regulations and relevant laws and regulations by conducting off-campus training without authorization, conducting off-campus training in disguised forms, training beyond the scope of permission, chaotic management, organizing competitions in violation of regulations, etc. shall be punished in accordance with the Education Law and the Private Education Promotion Law. , the Implementation Regulations of the Private Education Promotion Act and other laws, regulations and rules shall be punished.
