The Federation Council approved the law on confiscation of property for disseminating fakes about the Armed Forces of the Russian Federation.

As part of the initiative, it is proposed to seize property from persons convicted of disseminating deliberately false information about the RF Armed Forces, discrediting them, as well as public calls for extremist activities, separatism and the introduction of sanctions against Russia.

The explanatory note to the document noted that it was prepared in order to protect the national interests of the Russian Federation, the rights and freedoms of citizens from criminal activities and threats to national security.

As the press service of the Federation Council clarified, the changes necessary for these measures to work are being introduced into the Criminal Code of the Russian Federation and the Criminal Procedure Code of the Russian Federation.

“Those guilty of committing crimes against the security of the Russian Federation will be subject to not only criminal punishment, but also such a criminal law measure as confiscation of property acquired as a result of illegal activities or used to commit or finance crimes,” the press release says. As Vladimir Poletaev, First Deputy Chairman of the Federation Council Committee on Constitutional Legislation and State Building, clarified, the possibility of confiscation of property acquired by criminal means is already provided for by law. The amendments will expand the list of crimes for which such punishment is provided.

Thus, in addition to terrorist and extremist crimes, these will also include crimes against state security.

As noted in the explanatory note to the document, a similar approach is already used in legislation in order to suppress the financing of terrorism, extremist activities of an organized group, illegal armed group and criminal community.

Along with this, the document provides for the possibility, by court decision, to apply additional punishment in the form of deprivation of a special, military or honorary title or state awards in relation to persons who have committed crimes against the security of the Russian Federation.

The State Duma approved the document during a meeting on January 31. As the speaker of the lower house of parliament Vyacheslav Volodin noted, the authors of the initiative are 395 deputies of the State Duma.

“We have repeatedly discussed this issue with you - the absolute majority is in favor of the need to punish traitors who pour dirt on our country from abroad, soldiers and officers participating in the Northern Military District, support and finance the Nazi Kiev regime,” he said.

As Volodin noted, the adoption of the document will make it possible to deprive such persons of honorary titles, as well as confiscate their property, money and other valuables.

The head of the Federation Council Committee on Constitutional Legislation and State Building, Andrei Klishas, ​​also emphasized that during the discussion of the law, questions arose about how confiscation would work, as a result of which amendments were made to the document.

“The subject to confiscation is property that was acquired as a result of criminal activity, or property that serves as an instrument for committing a crime,” he said.
