China News Service, February 6 (Xinhua) Feng Xiaoguang, Director of the Sixth Procuratorate of the Supreme People's Procuratorate, revealed in an online interview with the Supreme People's Procuratorate on February 6 that in the past year, the Supreme People's Procuratorate has increased its supervision of civil false litigation and continued to Carry out special supervision of false litigation. From January to November 2023, procuratorial organs nationwide corrected 8,765 false litigation cases in accordance with the law.
Feng Xiaoguang said that on the basis of handling cases, the Supreme People's Procuratorate pays close attention to new trends in false litigation, conducts supervision of false arbitrations and false notarizations in accordance with the law and prudently, and prevents false litigation from rapidly spreading to non-litigation procedures. Typical cases were issued in April 2023 to encourage various localities to explore the supervision of false arbitration and false notarization. At present, many local procuratorial organs have established joint prevention mechanisms for false litigation with arbitration committees and notary agencies through case handling, information sharing, joint meetings, etc. to help prevent and rectify the illegal behavior of using arbitration and notarization to conduct false litigation.
Feng Xiaoguang pointed out that civil enforcement is an important law enforcement work to realize the parties’ rights to win the lawsuit. In recent years, the civil procuratorial departments of procuratorial organs across the country have focused on illegal activities that seriously infringe the substantive and procedural rights of parties, such as improper termination of execution, passive execution, failure to take preservation measures in accordance with the law, or illegal enforcement measures, and have continuously increased supervision. Pay attention to the use of procuratorial suggestions for similar cases to improve the overall supervision effect. In 2023, the Supreme People's Procuratorate will continue to promote in-depth and practical supervision of civil enforcement activities. In the first 11 months, procuratorial organs across the country accepted more than 74,000 civil enforcement supervision cases and made more than 61,000 procuratorial suggestions. The adoption rate of the courts during the same period was 94.3%.
Feng Xiaoguang introduced that from January to November 2023, procuratorial organs nationwide accepted more than 67,900 cases of supervision of civil trial activities and made more than 62,400 procuratorial suggestions. The adoption rate of courts during the same period was 93.6%. Civil procuratorial departments in various places have actively carried out supervision of violations of civil trial procedures and violations of judicial personnel, and have achieved good results.
