In the appeal, the legislator noted that, in accordance with Art. 128 of the Labor Code of Russia, in the event of the birth of a child, employees are entitled to leave without pay for up to five calendar days.

At the same time, as he clarified, labor legislation and other acts containing labor law norms do not apply to military personnel when performing their military service duties.

One of the presidential decrees and the federal law “On the Status of Military Personnel” provide that military personnel have the right to leave for personal reasons for up to ten days in the event of a serious health condition or the death of a close relative, fire or other natural disaster that befalls the family or close relative, in other exceptional cases - by decision of the commander of the military unit, the parliamentarian noted.

“In this regard, I ask you to instruct us to consider the feasibility of expanding the list of personal circumstances that provide for granting a serviceman the right to leave for up to ten days, namely in connection with the birth of a child,” the text of the appeal says.
