China News Service, February 1. The Supreme People's Procuratorate held an online interview with the director of the Supreme People's Procuratorate on February 1. Yuan Ming, director of the Second Procuratorate of the Supreme People's Procuratorate, said that in order to strengthen legal supervision in the new era, the Second Procuratorate coordinated the pilot operation of the intelligent auxiliary case handling system for criminal trial supervision in nine procuratorates across the country and achieved positive results.

Yuan Ming introduced that from December 2022 to June 2023, the Supreme Procuratorate organized a pilot operation of an intelligent auxiliary case handling system for criminal trial supervision in nine procuratorates, including the Beijing Municipal Procuratorate and the Dalian Procuratorate of Liaoning Province, using big data empowerment to improve criminal Quality and efficiency of trial supervision. By acquiring and refining data related to criminal judgment documents, the system adopts the "supervision rule preset + data modeling + keyword intelligent retrieval + data collision comparison to find clues" model to discover problems in criminal judgment documents, and then propose corresponding prosecutorial measures. Supervision methods can achieve the purpose of supervision of similar cases and promote the improvement of both the quantity and quality of criminal trial supervision. Each pilot unit attaches great importance to it, closely follows the pilot requirements, strengthens organizational leadership, sets up special work teams, refines the implementation of responsibilities, clarifies stage tasks, efficiently promotes the pilot work, and achieves significant results.

First, the quality and efficiency of supervision have been improved. The primary purpose of the criminal trial supervision intelligent auxiliary case handling system is to solve the current problems of narrow clues for criminal trial supervision and insufficient sources of protest cases. By carrying out pilot work, various pilot areas have expanded the source of protest cases and further improved the quality and efficiency of supervision. Since March 2023, the Procuratorate of Guiyang City, Guizhou Province has used the legal supervision model of common errors in criminal judgments to screen out more than 1,300 abnormal clues, verified more than 500 abnormal clues, and 88 cases have been completed. Relying on the promotion and application of the supervision model, the quality and efficiency of the supervision of criminal trial activities of the Procuratorate of Xiamen City, Fujian Province have been significantly improved. In the first half of 2023, the criminal protest rate was 0.54%, ranking among the top in the province. There were 9 written proposals to correct illegal trial activities. A year-on-year increase of 12.5%.

Second, the supervision of similar cases has been expanded. The expansion of individual case supervision to supervision of similar cases is the development direction of the intelligent auxiliary case handling system for criminal trial supervision and is also the long-term development goal of the pilot work. Through data supervision, the Procuratorate of Wuhan City, Hubei Province discovered that there was an error in fines and penalties in Ao's theft case. It then dug into clues about the errors in fines and penalties in other theft cases in the past ten years, and used integrated supervision. The case management department jointly with the criminal justice department The procuratorial department realized the transition from supervision of individual cases to supervision of similar cases, and finally issued notices to correct violations and procuratorial suggestions for similar cases to the court, urging the court to correct 12 erroneous judgments in a timely manner. In formulating and implementing the "Beijing Municipal Procuratorate's Special Supervision Work Plan for Cases of Revision of Sentences without Opening a Second Instance", the Beijing Municipal Procuratorate took digital procuratorial work as a work measure to solidly promote the implementation of the special activity of "Reforming a Sentence without Opening a Second Instance". Since May 2023, a total of 298 supervision clues have been discovered, and 35 supervision and correction cases have been carried out.

The third is to promote the management of litigation sources. The Dalian Procuratorate of Liaoning Province uses the criminal trial supervision intelligent auxiliary case handling system to detect cases in which trial procedures are illegal and serious infringements of the rights of parties. After research and judgment, the Procuratorate promptly transfers clues, and integrates in-depth supervision with the official crime investigation department to give full play to the advantages of prosecutorial integration. In response to the discovery of a high incidence of environmental pollution crimes in a certain area, the public interest litigation and procuratorial departments were jointly managed to control the source of litigation, promptly issued procuratorial recommendations, and urged relevant government departments to conscientiously perform their duties.

Yuan Ming pointed out that in response to the problem that the public security organs were lazy or negligent in checking criminal records, they would send procuratorial suggestions to the Municipal Public Security Bureau on such issues after investigation and verification, and work with the public security organs to strengthen and improve the work in terms of working mechanisms and processes. The Procuratorate of Shaoxing City, Zhejiang Province uses the supervision model to sort out the common supervision clues in a period of time or a type of cases. In response to outstanding problems, it prompts the grassroots courts to follow up and supervise from point to point to promote the centralized and comprehensive resolution of issues such as the application of procedures and the application of laws. .

Yuan Ming said that in the next step, the Second Procuratorate of the Supreme People's Procuratorate will guide procuratorial organs nationwide to comprehensively promote the application of intelligent auxiliary case handling systems for criminal trial supervision, further promote the standardized development of criminal trial supervision work, and comprehensively improve the quality and efficiency of supervision.
