  • Spain The messages between Bildu and the Interior for the ETA prisoners: "We maintain an effective and stable channel with the PSE, as you know"

  • Basque Country Otegi is at the forefront of the movement that demands the "key" to open the prisons

The National Court has decided to take up the case investigating the actions of the so-called 'ETA prisoners' commission'. Thus, Judge Manuel García Castellón will investigate the contacts between the Secretariat of Penitentiary Institutions of the Ministry of the Interior and the environment of those investigated in this case linked to ETA. The judge already has in his possession, as EL MUNDO reported, reports from the Civil Guard in which new conversations recorded on the phones of those investigated are recorded.

In these conversations, ETA lawyers and former prisoners talk about their contacts with the Interior and how from the Grande Marlaska Department they not only have direct and clear information on the evolution of their dynamics regarding ETA prisoners but also have the door open letter from the Ministry to send them their

proposals regarding grade progressions, illnesses and approaches of the prisoners

of the terrorist organization.

The Data Protection Agency investigates the Interior for leaking information on victims of terrorism to the ETA environment

His main interlocutor, according to Civil Guard reports, is the leader of Sare and former advisor to the Basque Government Joseba Azkarraga, who is the one who would maintain direct contact with the Ministry of the Interior and who would then transfer the messages to the lawyers. and ETA prisoners.

In these contacts, the network close to ETA also received confidential information about the steps that ETA victims planned to take regarding the movements of prisoners. This is the case of the data that Daniel Portero, president of Dignidad y Justicia, put on the table in a meeting with the head of the Marlaska prisons, Angel Luis Ortiz, and that was later provided by Azkarraga to the lawyers of the ETA members. Portero, son of the chief prosecutor of Andalusia Luis Portero, murdered by ETA,

has reported these events

(which can now also be investigated in the Court) to the Data Protection Agency.

In the order, Judge García Castellón admits the request of Dignity and Justice to reopen this case considering that there is novel investigative material that affects those investigated.

Thus, he understands that

the closure of the investigation was premature,

"due to the lack of investigative procedures necessary to clarify the facts being investigated. Thus, from the analysis of the computer devices of Carlos Saez de Eguilaz Murgiondo and Felipe San Epifanio San Pedro, and Focusing on the conversations of the 'Instant Messages' type, and in which the two investigated participated through the Telegram channel,

two conversations are relevant to the investigation

"Sortu-herritmoa bizitu"/"Sortu/enliven the rhythm of our people", which is a Telegram channel, which would be administered by the Sortu political party, and from which the investigated Carlos Saez de Eguilaz Murgiondo, as a user, receives abundant information about events and mobilizations and messages about the release of the prisoners of the terrorist organization ETA, which were later spread by organizations such as Etxerat or the magazine Kalera.info".

The judge highlights in his reopening document that guidelines and instructions relating to activity in certain areas are published on said channel, and the subsequent application of said guidelines by Sortu's media.

"And 'sare herritarra#izanbidea/Citizen Network #seelcamino', which is a Telegram channel, which would be managed by the Sare citizen network to support prisoners, escapees and deportees of the terrorist organization ETA," the order indicates.

For his part, the investigated Felipe San Epifanio San Pedro, who is also subscribed as a user on the public channel 'Sortu-Herritmoa Bizitu', as well as on the channel 'BarneKom', abbreviation of 'Barne Komite'/'Internal Committee' , where guidelines and instructions relating to activity in certain areas are published, and the subsequent application of said guidelines by Sortu's media is verified. The guidelines given are applied on the public access channel "Sortu-Herritmoa Bizitu"/"Sortu-vive el pueblo".

Therefore, the judge concludes,

"both investigated are users of Telegram channels where guidelines and instructions are given

on various issues and areas related to prisoners and escapees from the terrorist organization ETA, receiving abundant information and promoting campaigns and mobilizations in favor of of the prisoners of the terrorist organization ETA, not knowing who the administrators of the three Telegram channels mentioned are, two belonging to the Sortu political party and one to the Sare citizen network, it being essential to know this point to clarify the facts investigated in these proceedings ".
