Text/The country is the king

  As the Spring Festival approaches, some people may need to stick to their posts and work overtime. How to calculate overtime wages? On which days this year can triple wages be paid?

If you work overtime from February 10th to February 12th, you will receive three times the salary

  Article 44 of the "Labor Law of the People's Republic of China" stipulates: "In any of the following circumstances, the employer shall pay wages higher than the worker's wages for normal working hours according to the following standards:

  (1) If employees are arranged to extend their working hours, they shall be paid no less than 150% of their wages;

  (2) If workers are arranged to work on rest days but cannot arrange compensatory time off, they shall be paid no less than 200% of their wages;

  (3) If workers are arranged to work on statutory holidays, they shall be paid no less than 300% of their wages. "

  According to this regulation, when an employer arranges overtime work on rest days, it can use compensatory time off instead of paying overtime pay. However, if an employer arranges overtime work on statutory holidays, it must pay overtime pay and cannot use compensatory time off instead.

  During the Spring Festival holiday this year, February 10th to February 12th (Spring Festival, the second day of the lunar month, and the third day of the lunar month) are statutory holidays for the Spring Festival. If overtime work is organized during these days, overtime pay should be calculated and paid at three times the salary standard. The other days during the Spring Festival holiday are rest days or the adjacent rest days are swapped. Compensatory days can be arranged for overtime work on these days.
