The 45th president of the United States undoubtedly aspired to enter the history of his country: it is done. Indicted for the second time in two months, but now at the federal level, Donald Trump's legal setbacks are unprecedented for a former US president. Thursday, June 8, he announced his indictment by the federal justice in the case of his management of the archives of the White House.

Falsifications and porn

Indicted in early April in this case, Donald Trump is accused of having "orchestrated" payments to obtain the silence of three individuals whose revelations could have been damaging to him in the run-up to the 2016 presidential election, which he finally won.

In particular, $ 130,000 paid to the pornographic actress Stormy Daniels to keep quiet about an extra-marital relationship dating back to 2006.

Problem: although such payments are not illegal per se, Donald Trump has listed them as "legal fees" in the accounts of his company, the Trump Organization, which earned him 34 charges for "falsification of accounting documents".

The former president, who appeared in New York court on April 4, has pleaded not guilty.

The storming of the Capitol

A congressional committee, dissolved by the new Republican majority, investigated the Republican's role in his supporters' attack on the seat of Congress on January 6, 2021, as elected officials were certifying the victory of his rival Joe Biden in the 2020 presidential election.

In high-profile hearings, the Democratic-dominated panel said the former president heated his supporters white before the coup and "failed in his duty as commander-in-chief" during the assault.

In its final report, the commission said Trump should never be able to hold new public office after inciting his supporters to insurrection.

Its members also recommended that criminal proceedings be brought against him by the federal courts, including for calling for insurrection.

This is the file likely to lead to the most serious charges. A special prosecutor, Jack Smith, is also looking into the former president's role in attempts to overturn the 2020 presidential results. At the end of his investigation, he may or may not recommend that he be charged. But the final word will go to Justice Minister Merrick Garland.

The 2020 election in Georgia

A prosecutor of the state of Georgia has been investigating since 2021 "attempts to influence the electoral operations" of this southern state, won by a narrow margin by Joe Biden in 2020.

In a phone call whose recording was made public, Donald Trump had asked a senior local official, Brad Raffensperger, to "find" nearly 12,000 ballots in his name.

Fani Willis, the prosecutor of Fulton County that includes Atlanta, has appointed a grand jury to determine whether there is enough evidence to indict the real estate mogul. She managed to collect testimonies from her relatives, including her former personal lawyer Rudy Giuliani. The grand jury recommended indictments against several people without revealing whether the former president was a member.

His financial affairs in New York

In January, the Trump Organization was fined up to $1.6 million in New York for financial and tax fraud, a criminal first for the group, which awaits an even broader civil trial in the fall.

At the head of the justice of the State of New York, Letitia James, a democrat, has indeed filed a complaint against Donald Trump, his children and the Trump Organization.

It accuses them of "deliberately" manipulating the group's asset valuations – which includes golf clubs, luxury hotels and other properties – to obtain better loans from banks or reduce taxes.

It is seeking $250 million in damages on behalf of the state, as well as bans on running companies for the former president and his relatives.
