Every year, public procurements are made for around SEK 700 billion in Sweden. Therefore, the Prosecutor General believes that it is of great importance that all forms of corruption that may occur within the framework of public procurement are counteracted and prosecuted.

"In an extension, such corruption is also systemically threatening," the Prosecutor General writes in the appeal.

The Prosecutor General wants the Supreme Court to examine whether the defendants can also be convicted of breach of trust, something the Court of Appeal did not consider.

Release of damages

The Court of Appeal gave the former CEO and a former official at Region Skåne a suspended sentence for aggravated bribery. Another former regional official was acquitted entirely. The defendants also do not have to pay the previously awarded multi-million damages to Region Skåne and Region Västra Götaland.

The Court of Appeal held that neither of the two officials held the financial positions of trust required to meet the criteria for breach of trust.

Professor Olle Lundin sharply criticized the Court of Appeal ruling, which he believes in principle makes it a criminal offence to cheat with procurements.
