On the same day, the Higher People's Court of Shaanxi Province issued three normative documents (hereinafter referred to as the "three opinions") of the Opinions on Comprehensively Strengthening the Judicial Protection of the Ecological Environment in the Qinling Mountains, the Opinions on Comprehensively Strengthening the Judicial Protection of the Ecological Environment in the Yellow River Basin, and the Opinions on Comprehensively Strengthening the Judicial Protection of the Ecological Environment in the Han River Basin.
The "three opinions" respectively put forward specific requirements for Shaanxi courts in strengthening the judicial protection of the ecological environment in the Qinling, Yellow River Basin and Han River Basin, and adopted 8 specific measures in eight aspects, including pollution prevention and control, resource utilization, biodiversity protection, development and construction, cultural inheritance and promotion, environmental public interest litigation, and the trial and enforcement of ecological damage compensation cases, to further strengthen the judicial protection of the ecological environment in the Qinling, Yellow River Basin and Han River Basin.
"The Shaanxi High People's Court has vigorously promoted the 'specialization' of environmental capital trials, worked hard to promote cross-regional and cross-departmental coordination, strictly investigated and quickly dealt with illegal and criminal acts found to damage the ecological environment of the Qinling Mountains, and publicly exposed a large number of typical cases, forming a strong deterrent." Wen Zhigang, deputy director of the Shaanxi Provincial Development and Reform Commission (Qinling Office), said that it will further strengthen the connection and cooperation with the Shaanxi Higher People's Court, comprehensively focus on key areas such as vegetation protection, water resources protection, biodiversity conservation, development and construction activities, increase the investigation and handling of violations of laws and regulations, and strive to achieve benign interaction between administrative law enforcement and judicial adjudication.
According to statistics, in 2022, the Shaanxi ecological and environmental department dispatched more than 17,48 law enforcement personnel (times), inspected more than 6,83 enterprises (times), filed 2620,2 cases, and imposed a fine of 53 million yuan. 230 enterprises with environmental violations were publicly exposed, and 214 were interviewed.
The "Opinions on Comprehensively Strengthening the Judicial Protection of the Ecological Environment in the Han River Basin" issued this time mentioned that it is necessary to build a characteristic ecological judicial base. In this regard, Cui Xi, president of the Environmental Resources Trial Division of the Shaanxi Provincial Higher People's Court, said that in the trial of ecological and environmental cases, where it is inconvenient to repair in situ or there is no possibility of restoration, judicial restoration bases will be set up in conjunction with relevant departments, and methods such as off-site restoration, alternative restoration, and proxy performance will be explored, and efforts will be made to restore the infringed ecological and environmental functions, so as to achieve systematic balance and improvement of ecological and environmental functions.
Gong Fuwen said that the "three opinions" will fully promote the construction of a modern environmental governance system in terms of centralized jurisdiction across regional river basins, standardize adjudication standards, deepen judicial cooperation, build characteristic judicial bases, apply judicial science and technology, innovate trial execution methods, strengthen government-court linkage, promote law enforcement and judicial linkage, and expand the influence of environmental capital cases, and create a new pattern of integrated judicial protection of ecological environment resources in regions and river basins with Shaanxi characteristics.
