The woman's partner was thus sentenced to life imprisonment in the district court. The district court found that the beatings and traumatic brain injuries that the woman had received from the man led to her death. But the Court of Appeal said that it cannot be ruled out that the medication found in her body caused the death. The sentence was thus reduced to seven years in prison and the offence was changed to aggravated assault.

But the Court of Appeal disagreed. One member wanted to convict the man of murder and another wanted to convict him of both aggravated assault and aggravated manslaughter.

Will not try the murder issue

Fernlund's appeal does not concern the question of responsibility, whether the man should be convicted of murder or not, but only the length of the prison sentence for the crime of particularly aggravated assault.

"It is this issue that is considered to be of value from a precedent point of view and which could lead to the Supreme Court granting leave to appeal in the case. The punishment scale for extremely aggravated assault is a minimum of five and a maximum of ten years," the Swedish Prosecution Authority writes in a press release.

Decision of the Prosecutor General

Now the Prosecutor General will decide whether the Supreme Court will hear the case or not. The decision will come no later than April 27.
