The case of Ana Obregón and her recent motherhood is taking on signs of becoming a subject of study in Law Schools and doctoral theses. If last March the actress was erected as a global trend for having been the mother of a girl by surrogacy at age 68, last Wednesday, April 5, she dropped another bombshell in an interview for ¡Hola!. Confirming what many expected: his late son, Aless Lequio, is the posthumous father of the girl who was given birth in Miami through a surrogate mother. Therefore, she would be the biological grandmother of the girl registered as Ana Sandra Lequio Obregón.

"The normal thing is that it comes with a court ruling where it meets all the requirements. The important thing is that there is a final judgment. The biological factor does not have to influence. The capacity of the mother, her well-being, that of the child is verified...", Isabel Winkels, a lawyer specialized in national and international Family Law, describes to LOC. Partner-director of the firm Winkels Abogados, assures that Ana Obregón has had to be very well advised to be able to regularize a situation like hers. Replacement pregnancy is prohibited in Spain by article 10 of Law 14/2006, of May 26. So the actress has had to move through a series of legal twists and turns to be the legal mother of her granddaughter.

"This little girl is not my daughter, but my granddaughter. As for whether Ana Obregón can encounter problems when arriving in Spain, the lawyer has many doubts. "This girl would legally be the daughter of Ana Obregón. It is true that the Public Prosecutor's Office can oppose this and that in the Registry they say that she cannot be registered, but if it comes with an American sentence where she is recognized as a mother, they can hardly prevent recognition or registration. Because a foreign judgment is served in accordance with foreign law."

Being the daughter of Aless Lequio, Ana Sandra would also be the biological granddaughter of Alessandro Lequio (62). However, since only this gestation is Ana Obregó's decision, thiswould have no influence and only when she reaches the age of majority, the now newborn would have the right to demand proof that proves her relationship with Lequio to access her inheritance. "I would have the inheritance rights that any child can have. The issue, in any case, is open and complex," he said.
