"Prolonged refusal of food": in Sochi, the mother of a baby who died of exhaustion was detained

The Lazarevsky District Court of Sochi chose a measure of restraint in the form of house arrest for two months to the mother of the infant who died of exhaustion. This was reported to RT in the press service of the court.

The representative of the press service explained that the hearing was held behind closed doors. The accused is forbidden to leave the house, to communicate with the participants in the criminal case without the permission of the investigator, to send and receive postal and telegraph messages, to use means of communication and the Internet.

"The investigative department for the Lazarevsky district of the city of Sochi of the ICR continues to investigate the criminal case of causing death by negligence to an infant (Part 1 of Article 109 of the Criminal Code of the Russian Federation). Currently, the 33-year-old mother of the baby has been charged with this crime, she has been detained, "the report said.

Refusal to eat

According to media reports, the parents of the deceased child are St. Petersburg raw food blogger Maxim Lyuty and his common-law wife, 33-year-old Oksana Mironova. Young people promote a raw food diet (eating fruits and vegetables without heat treatment).

Fierce himself also calls himself a pranoede – one who "feeds only on the energy of the sun", without water. In his blog, he says that he allegedly healed from chronic diseases.

On February 11, Lyutoy's friend Oksana Mironova gave birth to a child. According to journalists, the birth took place in their rented house in Vardan without the supervision of doctors. Parents also did not show the baby to doctors and register it with raw foodists.

On March 8, the child became ill, he began to wheeze, and the parents brought the baby to the hospital. Doctors could only state the death of the baby, according to preliminary data, from malnutrition and pneumonia.

On the fact of the incident, the Investigative Department for the Lazarevsky District of the city of Sochi of the ICR for the Krasnodar Territory initiated a criminal case under Part 1 of Art. 109 of the Criminal Code of the Russian Federation "Causing death by negligence". The press service of the Investigative Department reports that the mother of the baby with a cohabitant lived in rented housing in the village of Vardan.

"In connection with the deterioration of the baby's health and his prolonged refusal of food, the woman and her partner independently decided to take the child to a medical institution on March 8 of this year, but the child died before he was taken to the hospital," the SC said in a statement.

According to media reports, after the incident, an administrative protocol was drawn up on Lyutoy under Art. 19.3 of the Code of Administrative Offenses on disobedience to the lawful request of a police officer when, after being detained, he tried to escape from an official car. Mironova is on her own recognizance.

You see, I am an Orthodox person, and he has a corral on the topic that he himself is a deity. All the time I said that he was crucifying here in front of us, and he could already walk on the water. According to her, the tragedy that occurred is quite expected.

"He always said in his courses that this (proto-eating) will allow you to rise to the level of a deity. Pediatrician, neonatologist and nutritionist Alexandra Kovalevskaya in an interview with RT said that in her practice there were parents who practiced raw food.

I managed to adjust the diet to vegetarianism and find an adequate replacement in products of plant origin, "tells RT Kovalevskaya. "Usually, adequate parents understand that with a nutritional deficiency, immunity weakens, which can lead to exhaustion of the body, infectious diseases and even death."

According to the pediatrician, if the pathologies from which the baby died were congenital, then probably he would not have lived up to a month, therefore, most likely, they are acquired.

Lawyer Nikita Nekrasov believes that it is potentially possible to consider three more articles according to which it is possible to qualify the actions of the parents of the baby.

"First of all, it is necessary to establish the exact cause of death, because in addition to the fact that the child was not fed properly, as the media write, pneumonia is present. You need to understand whether it was the fault of his parents that he died or not. If the cause of death is hunger, then there may be several elements of the crime," Nekrasov said. – It can be Part 1 of Art. 109 of the Criminal Code of the Russian Federation (Causing death by negligence) or Art. 125 of the Criminal Code of the Russian Federation (Leaving in danger). Also, the investigation needs to check two more versions - there may be Art. 106 of the Criminal Code of the Russian Federation (Murder of a newborn child by a mother), for example, if the mother was in a traumatic situation. "

According to the lawyer, Lyuty can avoid punishment if he proves that he was constantly at work, and the mother cared for the child.

"If it is proved that the blogger forced a woman to eat a certain way and also feed a child, the woman will not be found innocent. This will only be a mitigating circumstance, "says Nekrasov, "There are a lot of nuances here. Everything will depend on the intent of both parents."

Maxim Lyutoy's lawyer did not respond to RT's request to comment on the situation.
