Chapter 1 General Provisions

  Article 1 In order to promote the construction of the Hengqin Guangdong-Macao Deep Cooperation Zone (hereinafter referred to as the Cooperation Zone), promote the moderately diversified economic development of Macao, and enrich the practice of "one country, two systems", according to the "Overall Plan for the Construction of the Hengqin Guangdong-Macao Deep Cooperation Zone" (hereinafter referred to as "" "Overall Plan") and relevant laws and administrative regulations to formulate these Regulations.

  Article 2 These regulations apply to activities such as the construction and development promotion of cooperation zones.

  The scope of application of these regulations is the customs supervision area between the "first line" and "second line" of Hengqin Island determined in the "Overall Plan", excluding the Hengqin Campus of the University of Macau and the Macau jurisdiction of Hengqin Port.

The "first line" between Hengqin and Macao, and the "second line" between Hengqin and other areas within the customs territory of the People's Republic of China (hereinafter referred to as the Mainland).

  Article 3 The construction of the cooperation zone should adhere to emancipating the mind, reform and innovation, mutually beneficial cooperation, openness and inclusiveness, develop new industries that promote the moderate diversification of Macao's economy, build a new home that facilitates the life and employment of Macao residents, and build a new high-level openness integrated with Macao. system, improve the new system of Guangdong-Macao co-consultation, co-construction, co-management and sharing, promote the long-term prosperity and stability of Macau and better integrate into the overall development of the country.

  Article 4 The Guangdong Provincial People's Government and its relevant departments, and the Zhuhai Municipal People's Government and its relevant departments shall, according to the actual development and construction of the cooperation zone, authorize the relevant provincial and municipal management powers according to law or entrust them to the relevant institutions of the cooperation zone.

  The Guangdong Provincial People's Government and its relevant departments should formulate measures based on their own functions, increase guidance and support for cooperation zones, and use cooperation zones as experimental fields and pilot areas for deepening reform and expanding opening up.

  For the reform measures that have been implemented in other regions of Guangdong Province, if the cooperation zone has the conditions and actual needs, the Guangdong Provincial People's Government and its relevant departments should support the cooperation zone to explore and implement.

  Support cooperation zones to apply for authorization in a list-style manner, deepen reforms and expand opening up in key areas such as economic management, business environment, and market supervision.

  Article 5 The cooperation zone takes the lead in boldly innovating in important areas and key links of reform and opening up, pioneering trials, independent exploration, promoting the convergence of rules and mechanisms, and creating a regional development demonstration with Chinese characteristics and highlighting the advantages of "one country, two systems".

  The cooperation zone establishes a fault tolerance and exemption mechanism.

If the reform and innovation carried out in the cooperation zone fails to achieve the expected goals, but meets the strategic positioning and task requirements of the cooperation zone, the decision-making procedures comply with laws, regulations or relevant regulations, and no personal gain or malicious collusion to damage the public interest is made, the relevant units and individuals shall be punished. Exempt from pursuing relevant responsibilities.

Chapter II Governance System

  Article 6 The Cooperation Zone Management Committee is jointly established by Guangdong Province and Macao Special Administrative Region in accordance with the "Overall Plan" and implements a dual-chairman system.

The relevant units of Guangdong Province and the Macao Special Administrative Region, the Zhuhai Municipal People's Government, and the relevant agencies of the central government in Guangdong are members of the Cooperation Zone Management Committee.

  The Cooperation Zone Management Committee is the deliberation and decision-making body responsible for the development and management of the cooperation zone. It coordinates and decides on the following major matters in the cooperation zone. Among them, matters involving state powers shall be submitted for approval in accordance with the procedures:

  (1) Major planning, including the overall development planning of the cooperation zone, land and space planning, important special planning, annual work summary and plan arrangement, draft proposals for annual budget and final accounts, etc.

  (2) Major policies, including major policies that require the support of the provincial people's government, major policies in industries, finance and taxation, talents, customs clearance, innovation and entrepreneurship that need to be supported by the state, and legislative suggestions for cooperation zones, etc.

  (3) Major projects, including major projects in the fields of infrastructure construction, industrial development and public services in the cooperation zone.

The specific standards for major projects will be formulated separately by the management committee of the cooperation zone.

  (4) Appointment and removal of important personnel, including proposing candidates for the deputy director of the management committee, appointing and removing the secretary-general and deputy secretary-general of the management committee secretariat and the director and deputy director of the executive committee, as well as the function setting, working organization and personnel quota of the executive committee.

  The management committee of the cooperation zone may adjust the specific content of the major matters in the preceding paragraph according to the actual needs of the cooperation zone and in accordance with the deliberation and decision-making procedures.

  Article 7 The cooperation zone executive committee is the daily working body of the cooperation zone management committee. It undertakes the execution responsibility of the main body of the cooperation zone construction, is responsible for the specific development and construction of the cooperation zone, and performs international promotion, investment attraction, industry introduction, land development, project construction, Administrative management and public service functions related to education, medical care, culture and sports, social security, etc.

  The executive committee of the cooperation zone and its working organization are the statutory bodies that undertake the administrative management and public service functions related to the economy and people's livelihood management of the cooperation zone.

  Article 8 The economic and people's livelihood management and other related administrative management and public service functions of the former Zhuhai Hengqin New Area Management Committee of the China (Guangdong) Pilot Free Trade Zone, the former Zhuhai Hengqin New Area Management Committee, and the Hengqin Town People's Government shall be carried out by the cooperative District Executive Committee and its working agencies.

  Article 9 The relevant administrative management and public service functions such as economic and people's livelihood management and public service functions performed by the people's governments of cities divided into districts and below and their relevant departments according to laws, regulations and rules can be performed by the cooperation zone executive committee and its working agencies.

  Laws, administrative regulations, and departmental regulations of the State Council specify that the provincial people's government and its relevant departments perform economic, people's livelihood management and other related administrative management and public service functions, and entrust them to the cooperation zone executive committee and its working agencies. Laws, administrative regulations, and the State Council Unless otherwise specified in departmental rules and regulations, entrustment shall not be allowed.

  The local laws and regulations of Guangdong Province and the regulations of the Guangdong Provincial Government stipulate that the provincial people's government and its relevant departments shall perform economic, people's livelihood management and other related administrative management and public service functions, which shall be performed by the cooperation zone executive committee and its working institutions.

  The state management functions and powers undertaken by the Guangdong Provincial People's Government and its relevant departments may be exercised by the Cooperation Zone Executive Committee and its working organizations after approval by the State Council and its relevant departments.

  Article 10 The Guangdong Provincial People's Government and its relevant departments shall entrust the Executive Committee of the Cooperation Zone and its working organizations with administrative functions and powers to be exercised by the Guangdong Provincial People's Government and announced to the public.

  The list of powers and responsibilities of the cooperation zone executive committee and its working agencies shall be announced to the public by the cooperation zone executive committee.

  Article 11 According to the actual needs of the development of the cooperation zone, the executive committee of the cooperation zone can independently determine the personnel employed by its working organization, their salary standards and benefits, and establish a salary management system that is compatible with the performance goals.

  The executive committee of the cooperation zone may recruit staff from domestic and foreign professionals, and shall sign labor contracts with the hired staff.

  Article 12 Overseas staff of the cooperation zone management committee and executive committee who need to know state secrets due to work needs should report to the Guangdong Provincial Secrets Administration Department for approval.

The executive committee of the cooperation zone shall undertake specific confidentiality management work.

  The People's Government of Guangdong Province may legally authorize the Cooperation Zone Executive Committee to determine the classification level of state secrets.

  Article 13 The dispatched agencies established by the Guangdong Provincial Committee of the Communist Party of China and the Guangdong Provincial People's Government in the cooperation zone (hereinafter referred to as the Guangdong provincial dispatched agencies) are responsible for functions such as party building, national security, criminal justice, and social security, and perform territorial management functions. Cooperate with the cooperation zone management committee and executive committee to promote the development and construction of the cooperation zone.

The dispatched agencies of Guangdong Province and the executive committee of the cooperation zone shall establish a working mechanism for notification of major events and coordination of important work to strengthen daily information exchange and sharing.

  The agencies dispatched by the People's Government of Guangdong Province shall exercise administrative powers in their own names within the scope of their powers, and the list of powers shall be announced to the public after being approved by the People's Government of Guangdong Province.

  If the division of responsibilities between the agency of the Guangdong Provincial People's Government and the executive committee of the cooperation zone is not clear, the two parties shall reach a consensus after consultation and report to the management committee of the cooperation zone for filing.

  Article 14 Member units of the cooperation zone management committee in Guangdong Province shall establish a direct working contact mechanism with the cooperation zone executive committee and its working institutions, provide business guidance and support to the cooperation zone executive committee's working institutions, and assist in solving practical problems.

  The Guangdong Provincial Leading Group Office for Promoting the Construction of the Guangdong-Hong Kong-Macao Greater Bay Area should play the role of overall planning and coordination, decision-making staff, and promotion of implementation, and is responsible for coordinating relevant units in Guangdong Province to support the development and construction of the cooperation zone.

  Relevant departments of Guangdong Province should strengthen policy support and resource guarantee, create conditions and prioritize arrangements for matters involving cooperation zones.

The integrated government service platform and integrated administrative law enforcement platform of Guangdong Province should be open to the cooperation zone executive committee and its working organizations.

  Article 15 Zhuhai City shall establish and improve a long-term connection and communication mechanism with the cooperation zone to support, serve and guarantee the development and construction of the cooperation zone.

The social management, urban management and people's livelihood affairs of the Cooperation Zone need to be undertaken by Zhuhai City, which shall be determined through consultation between the Cooperation Zone and Zhuhai City.

  Article 16 Guangdong Province and the Macao Special Administrative Region shall negotiate and establish a revenue-sharing mechanism for cooperation zones.

  The cooperation zone implements first-level financial management, and the specific measures are formulated by the Guangdong Provincial People's Government.

  After deducting the cost, the income from the transfer of state-owned land use rights in the Cooperation Zone will be equally shared by the Cooperation Zone and Zhuhai City.

  The data of national economic statistical indicators in the Cooperation Zone will be included in the statistics of Zhuhai City.

  Article 17 The executive committee of the cooperation zone is responsible for compiling the draft budget of the cooperation zone, which shall be submitted to the People’s Congress of Guangdong Province for review and approval by the Guangdong Provincial People’s Government in accordance with the procedures with the consent of the management committee of the cooperation zone; the budget adjustment plan and draft final accounts shall be approved by the management committee of the cooperation zone Agreed, the Guangdong Provincial People's Government shall submit to the Standing Committee of the Guangdong Provincial People's Congress for review and approval in accordance with the procedures.

  Article 18 The competent department of auditing in Guangdong Province conducts auditing and supervision over the cooperation zone according to law.

  The cooperation zone management committee establishes a clean government audit mechanism, and conducts clean government supervision and audit supervision of the cooperation zone executive committee and its working institutions in accordance with regulations.

  Relevant departments of Guangdong Province and the cooperation zone have strengthened the exchange of clean government audit business to promote communication and coordination.

  Article 19 The Management Committee of the Cooperation Zone shall establish an evaluation index system for the effectiveness of the Cooperation Zone in promoting the moderately diversified economic development of Macao, and carry out annual evaluations.

The assessment results will be reported to the Guangdong-Hong Kong-Macao Greater Bay Area Construction Leading Group.

  In addition to laws, administrative regulations and national regulations, no items such as assessment and evaluation of the executive committee of the cooperation zone and its working institutions shall be set.

Chapter III Planning, Construction and Management

  Article 20 The cooperation zone establishes a planning system guided by the overall development plan of the cooperation zone, based on the land and space planning, and supported by special plans.

  The development and construction of the cooperation zone shall comply with the planning requirements, and innovate the management mode in terms of construction land, dual control of energy consumption, and pollutant discharge.

  Article 21 The use of land in the cooperation zone shall conform to the planning of the cooperation zone. Based on the principle of intensive efficiency and long-term development, a flexible and diverse land supply system may be established.   Article 22 The cooperation zone shall strengthen the construction of infrastructure, improve the integrated transportation system on the island, unblock external communication channels, strengthen the construction of "second-line" channels and surrounding infrastructure, strengthen the construction of the integrated three-dimensional transportation system of Qin-Macao, and promote the formation of a reasonable layout An infrastructure network with complete functions, smooth connection and efficient operation.

  Article 23 The cooperation zone shall build an urban big data center and a smart city operation management center based on the digital government infrastructure, build an efficient and convenient urban operation management service platform, support cross-departmental information sharing and business coordination, and realize the intelligent allocation of public resources .

  The cooperation zone establishes an intelligent application system covering areas such as urban governance, government services, community governance, and people's livelihood services, and strengthens cooperation in Qin-Macao smart cities.

  Article 24 The cooperation zone shall establish and improve the overall planning and coordination mechanism for the development and utilization of underground space, and strengthen the layered development and utilization of underground space in accordance with the principles of safety, efficiency, and moderation.

The underground space shall give priority to the construction of urban infrastructure and public service facilities such as transportation, municipal engineering, air defense and disaster prevention, and environmental protection.

  Explore land management reforms and innovations such as vertical development of urban underground space and hierarchical empowerment, and establish use rights on the ground, surface, and underground of construction land.

  Article 25 The cooperation zone shall improve the ecological environment evaluation and monitoring and supervision system, strictly abide by the red line of ecological protection, the bottom line of environmental quality, and the upper limit of resource utilization, formulate an ecological environment access list, implement the requirements for ecological environment zoning control, and strengthen afforestation and wetland conservation , beach reconstruction, marine ecological environment protection, etc.

  Article 26 The cooperation zone shall learn from domestic and international advanced experience, improve the level of urban construction and operation management, and coordinate the construction of public facilities such as sewage pipe network, solid waste treatment, information infrastructure, and public culture.

  Support the cooperation zone based on the integrated development of Qin and Macao, innovate the management mode of super high-rise buildings, and scientifically and reasonably set the building height limit standard within the scope of national regulations.

  Article 27 The executive committee of the cooperation zone shall, in conjunction with the agencies dispatched by Guangdong Province, establish a production safety committee in the cooperation zone to strengthen the supervision and management of production safety, improve the responsibility system for production safety, perform the duties of supervision and management of production safety, and organize the development of large and small production safety committees.   Support cooperation zones to carry out comprehensive pilot reforms of talent development systems and mechanisms, strengthen connection with Macao talent plans, and establish systems for talent recruitment, evaluation incentives, and scientific research management that are in line with international rules.

  Support cooperation zones to implement more open management measures for talent stay and residence, implement more relaxed temporary entry and exit policies for personnel, and convenient work visa policies.

  Article 37 Enterprise income tax shall be levied at a reduced tax rate of 15% for industrial enterprises in the cooperation zone that meet the conditions stipulated by the state.

For qualified capital expenditures of enterprises, one-time pre-tax deduction or accelerated depreciation and amortization are allowed in the current period in which the expenditures are incurred in accordance with national regulations.

  Enterprises in the tourism industry, modern service industry, and high-tech industries established in the cooperation zone will be exempted from corporate income tax in accordance with state regulations on the income obtained from new overseas direct investment.

  For domestic and foreign high-end talents and talents in short supply who work in the cooperation zone, the portion of their personal income tax burden exceeding 15% shall be exempted in accordance with state regulations.

  For Macao residents working in the cooperation zone, the portion of their personal income tax burden exceeding the tax burden of Macao shall be exempted in accordance with national regulations.

  Article 41 According to national regulations, professionals in the fields of finance, architecture, planning, design, etc., who have overseas practice qualifications such as Macao, provide services in the cooperation zone after filing under the conditions that meet the requirements of industry supervision, and their overseas practice experience can It is regarded as domestic working experience.

  Article 43 Encourage Macao's medical and health service providers to set up medical institutions in the cooperation zone in the form of sole proprietorship, joint venture or cooperation.

  Medical institutions in the preceding paragraph may, upon approval, use clinically urgently needed drugs and formula foods for special medical purposes that are already on the market in Macao, and use clinically urgently needed drugs that have been purchased and used by Macao public hospitals and have advanced clinical applications (large-scale medical products) equipment except medical devices).

  Support qualified Macao social service organizations to provide corresponding social services in the cooperation zone according to law.

  Macao residents with Chinese nationality may serve as members or leaders of social organizations in cooperation zones in accordance with national regulations.

Chapter 6 Promoting the Integrated Development of Qin and Macao

  Article 47 Support the cooperation zone to build a new high-level open system integrated with Macao, promote the efficient and convenient flow of elements, and create a market-oriented and legalized international business environment.

  Article 48 In accordance with relevant national regulations, qualified goods and articles enter the cooperation zone from Macao through the "first line" duty-free (bonded).

  For the goods entering and leaving the cooperation zone and Macao through the "front line" (except for goods in the transit cooperation zone), the filing management shall be carried out in accordance with national regulations, and the declaration procedures and elements shall be simplified.

  第四十九条 合作区与内地之间货物、物品、运输工具等应当经“二线”通道进出。

  从合作区经“二线”通道进入内地的免(保)税货物,按照进口货物有关规定办理海关手续,依法征收关税和进口环节税。

  第五十条 推动在合作区开展动植物及其产品检验检疫改革创新试点,探索建立更为简便、优化的检验检疫模式。

  第五十一条 合作区在“一线”按照规定实行合作查验、一次放行通关模式,依法实施卫生检疫。“二线”对人员进出不作限制。

  推动琴澳口岸实施更大范围、更深层次的信息互换、执法互助、监管互认,全面提升通关便利化水平。

  支持符合条件的澳门机动车辆免担保进入合作区。推动放开取得澳门机动车驾驶执照的澳门居民可以在合作区驾驶与准驾车型相符的机动车。

  第五十二条 合作区实施更加开放的人员出入境政策,为境内外人员进出合作区创造更加便利的条件。在横琴口岸设立的签证机关为外国人进入合作区提供口岸签证便利。

  合作区公安机关出入境管理机构可以受理、审批签发并制作外国人签证和停居留证件。对在合作区企业、高等学校、科研机构工作的符合条件的内地人员实行商务和人才签注备案制。

  第五十三条 支持合作区建立高度便利的市场准入制度,按照国家规定实施合作区放宽市场准入特别措施,放宽各类投资者在合作区开展投资贸易的资质要求、持股比例、行业准入等限制。合作区简化政务服务流程,进一步整合审批资源,提高审批效率,降低审批成本。

  支持合作区拓展国际贸易单一窗口功能,提高货物通关效率,促进跨境贸易便利化。

  合作区推行与澳门商事登记跨境通办,推动建立与澳门商事登记信息共享互通机制。

  第五十四条 支持合作区建立与其发展相适应的账户管理体系,推动合作区与澳门资金自由便利流动,建立适应高水平贸易投资自由化、便利化需要的跨境投融资管理制度。

  鼓励合作区、澳门的保险机构合作开发跨境保险产品,提供跨境保险服务。

  第五十五条 支持合作区在国家数据跨境传输安全管理制度框架下,开展数据跨境传输安全管理试点,建设固网接入国际互联网的绿色通道。

  支持合作区、澳门相关高等学校、科研机构在确保个人信息和重要数据安全前提下,实现科学研究数据依法跨境互联互通。

第七章 法治保障

  第五十六条 支持合作区加快扩大规则、规制、管理、标准等制度型开放,逐步构建民商事规则衔接澳门、接轨国际的制度体系。

  第五十七条 合作区执行委员会、广东省派出机构根据改革发展需要,经合作区管理委员会同意,可以建议广东省人民代表大会及其常务委员会制定法规,或者建议珠海市人民代表大会及其常务委员会制定经济特区法规,在合作区内实施。

  第五十八条 合作区执行委员会、广东省派出机构根据改革发展需要,可以建议广东省人民代表大会常务委员会、广东省人民政府在合作区暂时调整或者暂时停止适用有关广东省地方性法规、广东省政府规章的规定。

  珠海市地方性法规、珠海市政府规章中有关规定不适应合作区发展的,合作区执行委员会、广东省派出机构可以提出调整或者停止该规定在合作区适用的建议。珠海市人民代表大会常务委员会、珠海市人民政府应当支持并按照程序予以办理。

  第五十九条 合作区建立综合执法制度,经广东省人民政府同意,合作区执行委员会在职权范围内可以明确一个工作机构相对集中行使行政处罚权并向社会公布。

  合作区执行委员会可以结合合作区改革创新实践需要,制定行政裁量权基准,规范行使行政裁量权。

  合作区行政执法人员应当持中华人民共和国行政执法证开展行政执法工作。行政执法证核发、管理按照国家以及广东省有关规定执行,具体工作由合作区执行委员会组织实施。

  第六十条 有关单位和个人对合作区执行委员会的工作机构、广东省人民政府派出机构的工作机构作出的行政行为不服的,可以分别向合作区执行委员会、广东省人民政府派出机构申请行政复议。

  有关单位和个人对合作区执行委员会及其工作机构、广东省人民政府派出机构及其工作机构作出的行政行为不服的,可以依法向人民法院提起行政诉讼。

  第六十一条 加强粤澳司法交流协作,推动在合作区建立完善国际商事审判、仲裁、调解等多元化商事纠纷解决机制。

  鼓励合作区仲裁机构借鉴国际商事仲裁机构先进的管理体制和管理模式,建立国际通行商事仲裁机制,搭建琴澳仲裁合作平台。

  鼓励在合作区依法开展国际商事调解。当事人达成的、具有给付内容的商事调解协议,经公证依法赋予强制执行效力或者经人民法院司法确认,可以向人民法院申请强制执行。

  第六十二条 推动广东省、澳门两地的律师、公证、法律援助等法律服务业务融合发展。加快建设琴澳国际法务集聚区,优化涉外法律服务。支持在合作区成立律师协会,加强律师行业管理。

  取得律师执业证书(粤港澳大湾区)的人员,按照国家规定在合作区内办理适用内地法律的部分民商事法律事务(含诉讼业务和非诉讼业务)。

  澳门公证机构出具或者中国委托公证人(澳门)出具的民商事领域的公证文书,可以按照国家规定在合作区内使用。

  澳门居民在合作区申请法律援助的,法律援助机构可以按照澳门有关司法援助的条件、范围等规定核查申请人的经济状况等。

  第六十三条 支持在合作区依法设立域外法查明服务机构,提供包括澳门、葡语系国家(地区)在内的域外法查明服务。

  第六十四条 合作区执行委员会应当加强对市场主体生产、经营活动的监管,完善市场主体信用监管制度,建立市场主体信用信息公示、信用评价制度。

  第六十五条 合作区建立安全风险预警和防控体系,防范和化解重大风险。

  合作区加强反洗钱、反恐怖融资、反逃税、反非法集资监管,对禁限管制、高风险商品等依法实施口岸联合查验和入市监管。广东省有关部门应当加强对合作区财税金融政策执行的监督检查。
