Government

remains determined to focus on the controversy aroused in

Castilla y León

as a result of an alleged protocol against abortion that the vice president of Vox announced and championed in this community, but that days later, and after the open crisis and criticism , denied the president of this region, the popular

Despite this, and every time the Executive complains that it does not have this new protocol in writing, that it does not know what it consists of, it approves this Tuesday an agreement by which the Governing Council of the Junta de Castilla is required to have incompetence and León in relation to any actions that violate or undermine the Abortion Law.

This is the second action undertaken by the Government in just a few days with respect to Castilla y León.

First was the sending by the Ministry of Health of a requirement not to apply the new measures on abortion, warning that the Executive "will use all the mechanisms that the legal system makes available to defend the freedom of women and their right to voluntarily interrupt the pregnancy in the terms established in the current regulations".

Now the

Council of Ministers

goes a step further with this requirement of incompetence with respect to anti-abortion measures which, as explained by the Government, refers to any actions -including those constituting de facto- that violate or impair the rights regulated in Organic

Law 2/2010, of March 3, and RD 1825/2010, of March 25

, which develops it.

The Board has a period of one month to respond.

"All Possible Options"

This decision is prior to any conflict of incompetence to

the Constitutional Court

.

According to article 63.2 of Organic Law 2/1979, of October 3, of the Constitutional Court, the requirement of incompetence may be formulated within the two months following the day of publication or communication of the provision, resolution or act that is understood to be vitiated by incompetence or due to a specific act of application and will be addressed directly to the Government or the higher executive body of the other Autonomous Community, also reporting to the Government in this case.

"From the Government we are working on all possible options. We are not going to allow a single setback in the rights and freedoms of women," said the Minister of the Presidency, Félix Bolaños, who notes that the Executive is working "in different lines of action" and that it will adopt "all the legal measures that we have to adopt".

Effectively, this requirement of incompetence is so that "in the event that the Junta does not give a complied response, initiate actions before the Constitutional Court."

In the Executive they complain that they still do not even have the protocol, that nobody knows about it and it is not accessible.

They only know of the statements of

Juan García-Gallardo

, vice president of Castilla y León, of Vox, and therefore they are wary of Mañueco's subsequent denial.

They justify these actions precisely because they did not know the textuality of the document and because the vice president of the Board anticipated that it would enter into force this Monday and Mañueco spoke of new measures.
