It was on the night of October 16 to 17, 2020: a 28-year-old motorist, Olivio Gomes, followed on the ring road then on the A13 by an official from the Paris night BAC, was killed in the Beauregard housing estate in Poissy (Yvelines).

The policeman, accused of having killed him, may well have to render accounts before an assize court, which is extremely rare.

The Versailles prosecutor's office has just requested his dismissal, according to AFP.

All that's missing is the green light from the investigating judge in charge of the case.

Olivio Gomes' car had been spotted earlier by the official, 29 years old at the time of the events, and two of his colleagues from the BAC, after "erratic maneuvers" on the Paris ring road.

No speeding

What happened ?

For several kilometers, the police followed a car on the ring road then on the A13, without being noticed.

On board, Olivio Gomes, the driver and two passengers, aged 29 and 33, all from Yvelines.

It is from there that the versions are opposed: the police first evoked a refusal to comply.

But according to surveillance videos, they reported themselves to Olivio Gomes' vehicle 15 km further, at the level of the town of Chesnay (Yvelines).

The driver, without a license and under the influence of alcohol and cannabis, then immobilized his car in Poissy, below his residence.

No speeding is reported on the route.

These elements "could not legitimately suggest to the police that they were confronted with dangerous individuals" and "ready to do anything to escape", according to a source close to the investigation.

Intent to kill

Once arrived in Poissy, according to the version of the facts presented by the police officer, Olivio Gomes would have restarted and would have run into the official, who would then have opened fire.

Olivio Gomes is hit by three bullets: in the shoulder, in the neck and in the left shoulder blade.

He also had both lungs punctured.

But this version was quickly called into question by the investigation, the elements of which did not show that the car had run into the policeman, considered an "excellent shooter" by his colleagues.

"By using three times a potentially lethal weapon, the handling of which he knew perfectly well, aiming and hitting" the victim, "he could not, at this precise moment of the shooting, be animated by a homicidal intent voluntary,” according to the source.



The policeman was protected by his vehicle

Less than a week after the events, the author of the shootings was indicted for "intentional homicide" and placed under judicial control.

According to the experts, he was not "in danger" and not "in the path of the vehicle".

The Clio "could not materially reach" the policeman, "who was protected" by his own vehicle, "preventing any maneuver aimed at running directly on" him.

His reaction appears "to say the least disproportionate" and self-defense "cannot be accepted", says the source again.

"If the prosecution requests its referral to an assize court, we will challenge this position which is contrary to the elements that we have been able to identify in the file which legitimize the action of fire", reacted the lawyer of the police officer, Laurent- Frank Lienard, who had not read the final indictment, signed on January 6.

Olivio Gomes' family lawyer declined to comment.

“I see this as a new victory, from the start it has been only small victories: the expertise, the reconstruction… The truths come out.

Today, there is only one answer left to be sure, that of the judge,” said Leonel Gomes, the victim's brother.
