In detail, a real estate owner filed a lawsuit against a tenant, requesting that he be obligated to pay 675 thousand dirhams for the use of a property owned by her, in addition to any new amounts for the usufruct allowance until the date of the actual delivery of the property, while obligating him to pay fees and expenses and in return for attorney’s fees, explaining that the defendant seized the property. An apartment that she owns without right, and he has resided in it since January 2014 until now, and he refused to hand over the apartment to her and did not initiate the payment of the usufruct amount.

She added that she was damaged by not using the eye subject of the dispute from the date of the usurpation until now, and she did not dispose of it, and she was deprived of benefiting from the eye’s proceeds throughout that period and exploiting it, which prompted her to file a lawsuit against him, and a ruling was issued in which to expel the defendant, and then the plaintiff’s representative filed her case. the same and its aforementioned requests.

The court stated that what is proven in the papers is that the defendant was expelled from the eye, the subject of the dispute, according to a ruling issued by the judge of urgent matters, and the plaintiff’s attorney was demanding that the defendant be obligated to the value of his use of the property from January 2014 to date and any new amount until the actual eviction, and the defendant did not appear Although he declared it legal to present his defense or any defenses that undermine the lawsuit, and accordingly the court estimates the appropriate fee for the plaintiff from January 2014 to date at 675 thousand dirhams, while obligating him to pay fees and expenses.
