Court: Reporting crimes is a public right

A woman demands 100,000 dirhams from her ex-husband, accusing her of theft

A divorced woman filed a lawsuit against her ex-husband before the Al Ain Court of First Instance, in which she requested that he pay her financial compensation amounting to 100,000 dirhams, for the “damages he caused” to her, after he filed a complaint against her, in which he accused her of stealing a car that he had bought during the marital relationship. to use them in the service of their children.

The divorcee's lawsuit was based on the "malicious" admission of her ex-husband and the claim, noting that the communication caused her material and moral damage.

The court stated that whoever uses his right in a legitimate way is not responsible for the damage that results from that, adding that “using the right is not illegal unless it turns into malicious.”

And she affirmed that it is established by the judiciary that reporting crimes is a public right, whether for the victim or other individuals, and “it is not necessary for its practice that the whistleblower confirms in advance the veracity of what he reports, as that is the matter of the authorities concerned with the investigation, and then the whistleblower is not asked for compensation.” The damages that may be caused by the whistleblower against him, unless the matter is an abuse of this right that the communication was issued with ill intent, or at least characterized by recklessness and recklessness, and the inability of the whistleblower to prove the reported facts does not definitively lie.

Also, the acquittal of a crime due to lack of criminal intent does not indicate that the communication submitted by him was false.

And she said, “The complaint filed by the defendant against the plaintiff came within the scope of the right permitted to him by law, especially since the plaintiff did not prove the existence of material and moral damages incurred by her as a result of the defendant’s action, which negates the fault that necessitates responsibility, and the request for compensation came in an unfair manner.” A specific document that was rejected.
