The federal government is currently examining whether fare evasion on buses and trains should continue to be punishable as fraudulently obtaining services under Section 265a of the Criminal Code.

The legal policy spokesman for the Greens parliamentary group, Helge Limburg, considers a change in the current legal situation to be sensible.

Wolfgang Böhm, criminal judge at the district court in Zossen and lecturer at the Police University of the State of Brandenburg, would like to keep the criminal liability of fare evasion.

With Matthias Jahn, professor of criminal law at the Goethe University in Frankfurt and judge at the Higher Regional Court in Frankfurt, we discuss the Federal Minister of Justice's plans for video recording of the main hearing in the criminal trial.

Lawyers in particular have been criticizing the lack of such a regulation in Germany for a long time.

Judges, on the other hand, fear even lengthier proceedings and feel pilloried.
