The Abu Dhabi Court for Family and Civil and Administrative Cases ruled obliging a hospital to pay blood money of 200,000 dirhams and 100,000 dirhams in compensation for moral damage to the heirs of a woman who died as a result of a medical error committed by an obstetrician working in the hospital, during a laparoscopic operation to remove a uterine fibroid.

In detail, the heirs of a woman filed a lawsuit demanding that a hospital and an obstetrician working in the hospital be obligated to pay 300,000 dirhams in compensation for material and moral damages they suffered as a result of the death of their inheritor, in addition to obliging them to pay fees and expenses and in exchange for attorney's fees.

The heirs stated that their gene had undergone an operation to remove a fibroid tumor in the wall of the uterus in the hospital after she was suffering from anemia described in the medical report. The surgery was done with another endoscope to complete the operation, but the patient's condition deteriorated dramatically and she did not respond, and her pressure rose suddenly and there was a decrease in oxygen saturation until she died.

The complainants submitted a complaint to the Medical Liability Committee due to negligence and professional error in treating their gene, and the report of the Medical Liability Committee concluded that there was a serious medical error on the part of the obstetrician-gynecologist, and she did not follow safety steps when using the hysteroscope, which caused complications after the hysteroscopy surgery that led to to the woman's death.

In the rationale for the ruling, the court stated that the Federal Law on Medical Liability defined a medical error as “what is committed by a practitioner as a result of any of the following reasons, his ignorance of the technical matters that are supposed to be known by everyone who practices the profession of the same degree and specialization, and his failure to follow the professional and medical principles.” Conventionally, failure to exercise the necessary care, negligence and failure to follow caution and caution ».

And she confirmed that the report of the Medical Responsibility Committee of the Department of Health in Abu Dhabi proved that there was a serious medical error by the second defendant, due to her failure to follow safety steps when using the hysteroscope, which caused complications after the hysteroscopy surgery, which led to the death of the complainant’s gene, and based on This proved to the court that there was a medical error on the part of the doctor.

And she stated that what is established in the papers is that the doctor works for the hospital and under his supervision and control, and that a medical error occurred while performing her work in the hospital, and accordingly the hospital is responsible for bearing the compensation that is judged in favor of the complainants as a result of the doctor’s mistake, considering that she is one of his followers.
