According to the requirement from the Inspectorate for Care and Care (Ivo), the Academic Hospital in Uppsala should have a total of 612 care places available for the admission of patients within the somatic specialist healthcare by September this year at the latest.

The Court of Appeal, however, states that there are no express provisions in the law about how many care places a region must have, writes Läkartidningen.

In 2021, Ivo stated that the lack of care places at Akademiska entailed serious risks for patient safety, and if the problems were not rectified, the region risked a fine of SEK 20 million.

Unclear injunction

The Court of Appeal overturned the penalty order that time as well after an appeal by Region Uppsala.

The reason was that the injunction was not clear and precise enough, the court said.

- I think it is good, so that we can concentrate on patient safety and how we solve the whole, says the director of health and medical care Mikael Köhler.

This summer, Ivo made another attempt with an updated fine, where it was pointed out that there was no improvement - rather, it was an increased shortage of care places.

But now the Court of Appeal in Gothenburg has decided on a new suspension.

The court points out, however, that the need for care places is not assessed, only the design of the fine.
