In order to review the post-divorce child-rearing system, the National Legislative Council proposes to introduce "joint custody" in which both the father and mother have custody, and to maintain "single custody" for only one of them. In response to the compilation of the interim draft proposal, the Ministry of Justice will start public comments from the 6th of this month to solicit opinions from the public.

The interim draft draft compiled last month by a subcommittee of the National Legislative Council states, firstly, that "the best interests of the child must be taken into account."



On top of that, regarding the handling of "parental authority," which is the right and duty to take care of the child's personal care and property, there is


a plan to introduce "joint custody," in which both parents have custody after the parents divorce.

On the other hand, in this draft proposal, we will consider a mechanism that can appropriately respond to cases of spousal violence and parental abuse.



In addition, in the case of divorce or separation without an agreement between the parents, it is assumed that child support will not be paid. A new proposal was also made.



From the 6th of this month to February 17th of next year, the Ministry of Justice will hold public comments to solicit opinions from the general public.
