As reported by the

Superior Court of Justice of Aragon

, the 12 magistrates that make up the three criminal sections of the Court, responsible for trials for sexual assault, have met to unify the criteria with which to act.

The main decision has been that they will review the sentences in those cases in which the final sentence imposed the minimum sentence and that minimum has decreased with the legal reform.

That is the criterion that has already led to various reviews of sentences for sexual crimes in recent days.

It will be applied, for example, to the basic crime of rape, in which the new minimum has gone from six to four years.

This reduction has already been agreed by the courts in some cases.

The same is true of penetrative abuse of minors.

The minimum with the reform promoted by the Ministry of Equality has reduced the minimum sentence from eight to six years.

In the reviews of this type of case, the magistrates will collide with the prosecutor's position, after yesterday the State Attorney General ordered to oppose the review of sentences that, with the new law, can also be imposed, although the minimum has been reduced.

In the meeting headed by the president of the Court, magistrate

, it has been rejected to reduce the sentences in which the minimum would not have been applied exactly.

For example, a conviction for rape of six and a half years.

It would no longer be in the minimum of six years, so the lowering of the minimum to four years would not cause the review of the sentence.

The Court of Zaragoza plans to start shortly the ex officio review of all sentences likely to cause a review.

Ballestín has indicated that the minimum sentences are rarely imposed, which is why he estimates that few sentences will be reduced.
