In March 2021, the European Parliament lifted the immunity of both Carles Puigdemont and former ministers Toni Comín and Clara Ponsatí.

He did so after Judge Llarena issued the request with the aim of being able to continue executing the European arrest and surrender warrants.

That decision of the European Parliament is the one that will be debated at the hearing that will take place next Friday in Luxembourg.

Puigdemont, Comín and Ponsatí want the TGUE to now annul Parliament's decision to accede to the request made by the High Court.

They will argue an alleged violation of fundamental rights.

The court's ruling is expected towards the end of January or beginning of February.

If the European courts agree with Puigdemont and protect his immunity, he could return to Spain immediately without being arrested, say his defense sources.
