The Court of Appeal in Dubai upheld a ruling convicting a (Khaliji) who was proven to have used drugs during the period of his periodic examination by the General Department of Anti-Narcotics in Dubai Police, and punished him with a fine of 30,000 dirhams.

The facts of the case indicated, as established by the court’s certainty, and the investigations of the Public Prosecution, that the accused is one of the persons subject to the aftercare system (periodic examination) by the General Administration for Drug Control, after being referred from the General Administration of Punitive and Correctional Institutions, in light of the procedure followed and the measures established regarding subjecting Released in cases of abuse for periodic examination.

The case papers indicated that the accused signed a special declaration stating that he did not object to giving a sample to be examined, and that he adhered to the system of aftercare and periodic and sudden examination, and in case of breach, he bears all the legal procedures resulting from that, and he was given a schedule of dates for periodic reviews.

On the date set for him in advance, the accused attended and gave a sample of his own to be examined and left the administration, and the result was received that it contained two compounds of narcotics and psychotropic substances listed in the schedule of the Federal Law on Combating Narcotics and Psychotropic Substances.

By questioning him during the Public Prosecution's investigations, the accused confessed to using the narcotic substance, and also admitted his crime during the court session, and asked for clemency.

After examining the incident, the court concluded that what was confirmed in the case papers, and what it was satisfied with, and it was proven in the seizure report and the report of the General Department of Criminal Evidence, that the accused had used psychotropic substances in cases other than those authorized by law, and without a medical prescription, and he was aware of their nature and for the third time, And decided to punish him in accordance with Federal Law No. 30 of 2021 regarding combating narcotics and psychotropic substances, and a fine of 30,000 dirhams.
