The debate between "classical" feminists and

theory , on account of the new Trans Law, will open a new stage on the immediate horizon that may be of vital importance.
In the coming weeks, the Constitutional Court plans to issue a ruling on the appeal of unconstitutionality filed by the PP to the Catalan law that reformed the sexist violence regulations to include the same postulates on transsexuality and gender violence that have inflamed the controversy over the state law.

In this way, if the Minister of Equality, Irene Montero, does not manage to speed up the processing of the Transnational Law as much as possible, the sentence could fully break into a debate that has caused tension like few others on the left.

Why could this ruling be decisive?
Because the appeal of the PP, admitted for processing in
May 2021
, claims that not all transgender women can be included as victims of gender violence, because it does not share that they can "be subject to gender violence also those who are registered, to all legal effects, men».
Specifically, the Catalan law establishes, according to the appeal, a distinction between transgender women and women who are not, "differentiation completely incompatible with our legal system," according to the PP.
The appeal adds that in the current legal system, "sex" exists as a reality with legal projection and, within this notion, two categories reside in the Constitution, "the male sex (man) and the female sex (woman)".
So the PP appealed because it believes that the Catalan norm "denatures the concept of sex" in the legal system.
And the Constitutional Court will have to rule on this in a sentence that could tip the scales in a debate as bitter as that of the details of the laws on transsexuality.
Contacts with the PP
In fact, the "historical" feminists of the classic wing of the PSOE have maintained contacts with leaders and deputies of the PP in recent weeks, and have told them that they await that sentence with great interest.

The PP recalls in its appeal -and the classic feminists of the PSOE agree- that once the Catalan modification has been produced, not only are there no differences between transsexual (or transgender) women and the rest, but the process of rectifying sex itself is considered a data «specially protected and reserved from general knowledge».
