Justicia Podemos skips the PSOE-PP pact not to press with names and hinders the unblocking of the CGPJ
It seems that the unlocking of the renewal of
the General Council of the Judiciary (CGPJ)
, four years after the expiration of the mandate, is finally about to arrive.
PSOE and
PP
have already agreed on measures that include relevant transfers by the
PSOE
, according to eldiario.es.
According to sources of the negotiation cited by that medium, the Socialists would give the go-ahead to judges who have had some political responsibility not being able to exercise jurisdictional tasks until two years after their dismissal.
The intention is that the measure does not have a retroactive effect.
In this way, it will not affect the three ministerial judges of the Government -
Margarita Robles
(Defense),
Fernando Grande-Marlaska
(Interior) and
Pilar Llop
(Justice) - in the face of returning to judicial careers when they leave politics.
But, if finally the measure did have a retroactive effect, if these ministers wanted to secure their positions as judges prior to entering the Executive, they should resign their positions if the measure finally did have a retroactive effect.
This fact would provoke a crisis in the
Government of Sánchez
, which should look for substitutes to occupy these portfolios
For the time being, the agreement includes that the judges and magistrates who are appointed to elected political or government positions cannot exercise in those two years, although they will receive their salaries and perform legal functions in State institutions.
The measure would affect all positions with a rank higher than general secretary, according to the sources of the negotiation consulted by elDiario.es.
