There is still no government, the legislature has just begun and one of the most heated battlegrounds between the majority and the opposition is already looming: the promotion of
pro-life policies
, which aim to discourage the use of
abortion
as much as possible .
A theme, on which already from the electoral campaign there had been several signs, regarding the attention that the center-right majority would have reserved to the question.
A legislature of "ideological" battles?
On "principled" issues, the rights and freedoms of individuals have always been an issue on which political opposition risks leading to an "ideological" battle, in which the work of mediation and the hope of finding an agreement become more difficult bipartisan tapers strongly.
That these were topics that were deeply felt by the majority forces is nothing new today: the premier
in pectore
Giorgia Meloni
in recent months has never lost an opportunity to reiterate that the policies for the family, to reverse the trend on the decline in births and set up its government action on
pro-life
policies
would be placed at the center of his agenda for Palazzo Chigi.
But, in fact, while waiting for the executive to be formed and the minister for the family to take office (we are talking about
Simona Baldassarre
, MEP of the League close to the new president of the Chamber, Lorenzo Fontana), there are already some signs should be read and interpreted in this sense.
Handle
Maurizio Gasparri (Forza Italy)
The Gasparri bill on the legal capacity of the child
One of these is the presentation (or, better, re-presentation) to the Senate of the
bill
signed by
Maurizio Gasparri
, which aims to
recognize the legal capacity of the child
, therefore even before birth, as currently envisaged by the Civil Code.
The opposition, from the Democratic Party to the Left to the 5S, immediately raised their shields, with the first to define the initiative as "unprecedented" and "anti-abortion".
Furthermore, the provision would be "aggravated" by another text, parallel and always first signed by Gasparri, with which it is proposed to
establish the "Day of the unborn child"
.
For his part, the senator of Forza Italia, who also presented the
bill to introduce the crime of surrogacy
, he later explained that he did not want to enter into controversy, clarifying that it is a bill presented at the beginning of the previous legislature and that the bill corresponds to “a moral legacy of Carlo Casini, founder of the Movement for Life.
But so far no one had noticed it… ".
Gasparri also wanted to clarify that his bill "
does not have the objective of abolishing law 194, but has the realistic objective of reaching its full application
, even in the part of assistance to women", so that the choice "is not an obligatory choice".
Small, useful clarification.
Article 1 of the Civil Code prescribes: “Legal capacity is acquired from the moment of birth.
The rights that the law recognizes in favor of the conceived are subordinated to the event of birth ".
The bill of the blue senator provides for the recognition of legal capacity before birth, already at the moment of conception.
“My goal - added Maurizio Gasparri - is to open a discussion on the subject of abortion, motherhood, life”.
