As of March 1, commercial canvassing by telephone cannot take place on weekends and public holidays.

From Monday to Friday, the schedules will be framed.

However, this framework will not apply "if the consumer has given his express and prior consent to be called, the professional having to justify this".

Commercial canvassing by telephone will be prohibited on weekends and public holidays, and its hours supervised from Monday to Friday, from March 1, 2023, according to a decree published Friday in the Official Journal.

“Consumer canvassing by telephone is authorized from Monday to Friday, from 10 a.m. to 1 p.m. and from 2 p.m. to 8 p.m. It is, however, prohibited on Saturdays, Sundays and public holidays”, defines this decree.

This framework will apply "both to people not registered on the Bloctel list", which allows them to register their number free of charge to oppose cold calling, "as well as to those registered but requested under a contract in Classes".

On the other hand, this framework will not apply "if the consumer has given his express and prior consent to be called, the professional having to justify it".

Sanctions provided for in the event of abuse 

A person cannot be solicited "by telephone for commercial prospecting purposes more than four times a month by the same professional or by a person acting on his behalf", it is specified.

Finally, "when the consumer refuses this canvassing during the conversation, the professional refrains from contacting him or attempting to contact him before the expiration of a period of sixty calendar days from this refusal".

Violation of these rules may be sanctioned with an administrative fine of 75,000 euros for a natural person and 375,000 euros for a legal person.
