Forcing a man to bear the cost of treating a fetus in the womb of his ex-wife

The Abu Dhabi Court for Family and Civil and Administrative Litigation has obligated a man to pay his divorced 10,000 dirhams for the cost of treating their fetus, noting that the alimony for a young boy who has no money is owed to his father until the girl marries and the boy reaches the point where the likes of him earn.

The details of the case refer to a woman filing a lawsuit against her ex-husband, who demanded that he pay her 10 thousand dirhams, as well as obligate him to pay fees and expenses and in return for attorney’s fees, noting that she was the wife of the defendant and divorced and that she is the incubator of their children, and it was estimated that their daughter would contract a disease while she is a fetus inside the womb, The insurance companies refused to cover the costs of the treatment, forcing them to pay 10,000 dirhams, and the defendant refused to pay these costs.

In the ruling’s merits, the court stated that it is stipulated in the Personal Status Law that the maintenance of a young boy who has no money is borne by his father until the girl marries and the boy reaches the point where his peers earn unless he is a student who continues his studies with usual success.

She indicated that the evidence from the payment receipt issued by a medical facility is that the plaintiff initiated the payment of 10 thousand dirhams, and reassured the court of what was stated in the payment receipt, and then it was obligated to the judiciary to oblige the defendant to pay the plaintiff the amount, and it ruled obligating the defendant to pay the plaintiff 10,000 dirhams, obligating him to pay fees and expenses.
