In the details, a man filed a lawsuit against his ex-wife, demanding that she pay him 100,000 dirhams in material and moral compensation, noting that the defendant was his wife and he had two children from her, and she traveled with her son and returned after a year and a half, after he begged her to see his son, and after her return She sent him a letter containing insults and slander, and she was convicted under a penal verdict.

The court stated in the merits of the judgment that the evidence of the penal judgment is the conviction of the defendant for the accusation of insulting the plaintiff, and then the judgment has obtained the authority of the res judicata in what it was decided before the civil court, and the element of error has been provided by the defendant, and it has been definitively proven against her, and the clear evidence That this error is the reason for the damages to the plaintiff, and the illegal act on the basis of which the criminal case was filed was the very one on which the civil lawsuit was filed, which makes the elements of responsibility of error, damage and a causal relationship available to the defendant.
