He continued: «The law emphasized the necessity of reporting in the event of the flight of the assistant worker, explaining this in Article (17) where it stated: (The employer must inform the Ministry within five days of the worker’s absence from work without a legitimate reason, and the worker must inform the Ministry within 48 hours of leaving work without the knowledge of the employer).

The legal researcher, Dr. Mohsen Muhammad Al-Khbani, said that with regard to the obligations of recruitment agencies, the Federal Law regarding domestic workers stipulated in paragraph (4c) of Article (4) of it, that recruitment agencies bear the expenses of returning the worker to his country in addition to providing an alternative for him. Without incurring any additional expenses for the employer, or refunding all amounts paid by the employer - at the latter's choice - if it appears, or occurs, that the worker left the work, in other than the authorized cases, as indicated in the executive regulations of this law during the aforementioned probationary period In Article (9) of this law.

He added: “In the event that the recruitment office violates this provision and the provisions contained in Article Four, as confirmed by Article (30) of this law and without prejudice to any harsher penalty stipulated in any other law, the recruitment office shall be punished with a fine of not less than 50 thousand dirhams and not more than 100,000 dirhams, and the penalty is doubled in the event of recurrence of this act within one year from the date of the sentence.”

And he continued: «On the same side, Article (10) of the same law confirmed that the recruitment office is obliged to return to the employer the full sums that the latter paid to the office, or part of them, as determined by the executive regulations of this law in any of the following two cases: The first is that the worker terminates the contract after the probationary period, without a reason due to the employer, and the second is that the worker quits after the probationary period without an acceptable reason.”
