The Supreme Court of the Russian Federation upheld the verdict of two residents of the Krasnoyarsk Territory who raped and killed a 12-year-old schoolgirl.

Last year, one of them was sentenced to 23 years in a strict regime colony, and the second was sentenced to almost ten years in a juvenile colony, since he was 14 years old at the time of the crime.

They failed to challenge the decision of the court in the highest instance.

“The meeting is over, by the decision of the Supreme Court, the verdict passed earlier was left unchanged,” RT was told in the press service of the Supreme Court of Russia.

12-year-old schoolgirl Marina Kh. was killed on May 29, 2020.

That day, she and her younger sister went to take home a cow from the grazing and did not return home.

In the evening, the parents sounded the alarm and contacted the police.

The next day, a full-scale search began in the village, with the participation of more than fifty policemen and volunteers.

Two days later, Marina's body was found in a fire well at an abandoned construction site.

The investigators who arrived at the scene revealed numerous bodily injuries - before her death, the girl was raped and strangled.

“During the search activities in an abandoned fire tank about three meters deep, the body of a child with signs of violent death was found,” the official statement from the investigative department of the ICR for the Krasnoyarsk Territory and the Republic of Khakassia said.

Investigation and suspects

After the discovery of the schoolgirl's body, a criminal case was opened for murder.

The IC brought in experts to collect genetic material from the villagers in order to identify those involved in the crime.

Soon the first suspect was arrested.

It turned out to be a 25-year-old local resident with a certificate of mental retardation - he was the last person they saw the deceased with.

The detainee immediately confessed to the crime, but he claimed that he single-handedly raped and killed the schoolgirl.

This version caused doubts among the investigators.

Soon, the search engines found the underwear of the murdered near the crime scene.

Forensic experts concluded that there were three rapists.

On June 6, the second suspect was detained - at that time 19-year-old Rodion S., who also had a psychiatric diagnosis.

In the village, he was known as a member of a gang of teenagers who terrorized the locals for several years.

Initially, S. claimed that he only participated in the rape and did not kill Marina.

During interrogations, he told the investigators about another participant in the crime, 14-year-old Ilya K. Residents of Lower Koya later told reporters that it was the underage K. who was the most cruel in the gang that kept fellow villagers in fear.

Not the first rape

The villagers also staged a gathering and called local law enforcement officers to account.

On June 3, representatives of the district department of the Investigative Committee, the police and the prosecutor's office spoke to them, assuring them that the case would be thoroughly investigated.

It was noted that all previous complaints were considered in accordance with the regulations established by law - the parents of juvenile lawless people were punished with fines.

When the story of the murder of a teenage girl in Lower Koya became publicized in the media, it turned out that the detained minor suspect had previously raped the murdered woman.

In 2019, Marina told her mother about the incident, and she contacted the police.

The public was outraged that the law enforcement agencies of the Shushensky district of the Krasnoyarsk Territory were aware of the crime and did not bring the rapist to justice.

As the mother of the deceased girl, Elena Kh., told local journalists, according to her statement, they refused to initiate a criminal case, since at the time of the alleged crime, Ilya K. was 13 years old, and criminal liability comes from 14.

Krasnoyarsk media also wrote that, having not received help from law enforcement agencies, Marina's mother allegedly tried to deal with the juvenile rapist herself, after which the teenager's mother wrote a statement against her.

The woman was convicted of endangering the life of a minor and sentenced to probation.

On June 11, Ilya K. was detained, his involvement in the crime against a schoolgirl was confirmed by a medical examination.

Court and sentence 

The murder in Lower Koya attracted the attention of federal officials.

The head of the Investigative Committee of the Russian Federation, Alexander Bastrykin, put the investigation into the criminal case on the murder of a schoolgirl under control in the central office of the Investigative Committee.

The investigation and trial in the criminal case of the murder of Marina Kh. lasted more than a year, only two defendants, Rodion S. and Ilya K., were put on trial. Since the crime concerned the sexual integrity of a minor, the materials of the investigation were not disclosed, and the hearings were held behind closed doors.

In August 2021, the court found Rodion S. guilty under four articles of the Criminal Code: sexual assault, rape and murder of a minor, and involvement of a minor (Ilya K.) in the commission of a crime.

The senior defendant was sentenced to 23 years in prison to be served in a strict regime colony.

Ilya K. was found guilty of sexual assault and complicity in rape and murder.

He was sentenced to nine years and 11 months in an educational colony.

The court also satisfied the claim of the mother of the deceased girl for 2.5 million rubles against Rodion S. and for 2 million rubles against his minor accomplice.

At the trial, both pleaded guilty and repented, but later the defense side filed an appeal against the verdict.

On the fact of the murder of a schoolgirl in Nizhnyaya Koya, the Krasnoyarsk prosecutor's office conducted an inspection of the work of the organs of the system for the prevention of neglect and juvenile delinquency - it turned out that no work and conversations with teenagers were carried out.

In addition, as reported by the regional supervisory agency, during the investigation, submissions were made to the head of the Shushensky district, the head of the district education department and the head of the Shushensky Ministry of Internal Affairs.
