Zhang Xiaojin, director of the Fourth Procuratorate of the Supreme People's Procuratorate, introduced that from 2021 to June this year, procuratorial organs across the country have prosecuted 376 people for various securities crimes.

Among them, 147 people were prosecuted from January to June this year, a year-on-year increase of 93.4%.

  Zhang Xiaojin pointed out that in recent years, the procuratorial organs have conscientiously implemented the central government's deployment requirements on strengthening the rule of law in the capital market and cracking down on illegal securities activities in accordance with the law. This rate of increase is still relatively large.

A number of cases in key areas such as financial fraud, market manipulation, and insider trading with significant social impact have been handled, forming a high-pressure situation to combat securities crimes.

  The second is to improve the system and mechanism for the prosecution and handling of securities cases.

On September 18, 2021, the Procuratorial Office of the Supreme People's Procuratorate stationed in the China Securities Regulatory Commission was unveiled and established; continued to strengthen the construction of seven securities crime handling bases in Beijing, Tianjin, Liaoning, Shanghai, Chongqing, Qingdao, Shenzhen, etc., to focus on handling difficult and complex securities crime cases; Strengthen the case-handling capacity of the procuratorial organs in areas with a large number of cases, such as Zhejiang and Jiangsu.

  The third is to strengthen judicial standardization.

On April 30 this year, the Supreme People's Procuratorate and the Ministry of Public Security jointly issued the revised standards for filing and prosecuting securities crimes.

This time, the Supreme People's Court, the Ministry of Public Security, and the China Securities Regulatory Commission have selected 5 typical cases from securities crime cases that have been successfully handled in recent years for publication.

Next, we will continue to compile and distribute typical cases and guiding cases to guide the handling of securities crimes.

  Fourth, protect the rights and interests of investors in accordance with the law.

The procuratorial organs have implemented the whole process of case-handling to recover assets and restore losses, adhere to the principle of "recovering as much as possible", and try to help investors recover their economic losses as much as possible through various means such as "double-checking" money laundering criminal clues and supporting special representatives' lawsuits.

  The fifth is to attach importance to the governance of the source of complaints.

Closely integrated with supervision and case handling, assisting in identifying common problems and loopholes in listed companies, financial institutions, and industry supervision, etc., through the formulation and issuance of procuratorial recommendations, and carrying out compliance with the companies involved in the case, to achieve "handling one case and managing one". Treat "already sick", and prevent "not yet sick", and promote the treatment at the source.

  Sixth, strengthen communication and cooperation between administrative and judicial departments.
