The Abu Dhabi Family Court and Civil and Administrative Claims ruled to expel a tenant from an apartment and hand it over to the owner of the property, after the tenant forcibly seized it and refused to evict amicably, and he also failed to attend the lawsuit sessions.

In detail, a property owner filed a lawsuit against a tenant, who demanded his expulsion from the apartment and handing it over free of concerns and persons, obligating him to pay the fees and expenses of the lawsuit and in return for attorney's fees, indicating that he is the owner of the apartment and the defendant usurped the apartment, and that he tried to recover the apartment in amicable ways, but the tenant did not respond .

The court stated in the reasons for the ruling that the evidence from the papers is that the plaintiff is the owner of the property according to the title deed attached to the papers, and he claimed that the tenant usurped the apartment while he did not appear before the court, despite his announcement to pay the lawsuit with any payment that could be obtained from it, which the court concludes with That the defendant enters the apartment and resides in it without a document that authorizes him to do so, he is usurping the apartment, and accordingly, the plaintiff’s request was based on a document from reality and the law, and the court ruled to expel the defendant from the apartment subject of the lawsuit, and oblige him to pay the lawsuit fees and expenses.
