“The proposal to include children under guardianship in the list of heirs by law can be supported, since this can create additional guarantees for material and financial support for them,” the lawyer said.

According to Solovyov, such an opportunity “could be provided for gratuitous guardianship”, which is usually established by close relatives, for example, grandparents, aunts and uncles in the event of deprivation of parental rights by blood father and mother.

“In other cases, there are other civil law mechanisms for a paid guardian to express his will to transfer all or part of his property to a child under his guardianship, for example, a gift agreement,” he added.

Earlier in Russia, it was proposed to give orphans the right to inherit the property of a guardian.
