For its part, the court clarified in the merits of its ruling that according to the Evidence Law, “the plaintiff must prove his right and the defendant has to deny it.” Each of the two parties, in whatever state the case was in, may direct the decisive oath to the opponent, provided that the incident on which the oath is directed is related to the person to whom it was directed. to him, and if it was impersonal to him, it focused on his mere knowledge of it, noting that the plaintiff had instituted her lawsuit by requesting to compel the defendant to transfer the ownership of the car from his name to her name and direct the decisive oath to the defendant, based on his promise to do so to her, and it was the case that the defendant He attended and denied his promise to her and took the decisive oath, which results in her swearing or renouncing her oath to settle the dispute regarding the incident that was the subject of her, so that the litigant may not then prove that incident by other means of proof.
