  • Asbestos Historical compensation agreement between the victims and Metro de Madrid

The judge investigating the cases of deaths and those affected by exposure to asbestos in

the Madrid Metro

has shelved the case, considering that the crime cannot be attributed to any specific person, in line with what the Prosecutor's Office recently argued after the agreement reached in July between the parties.

According to the order of the head of the Investigating Court number 23, advanced by El Confidencial and to which Efe has had access, Judge

Arturo Zamarriego

decrees the provisional dismissal arguing that, as the Prosecutor's Office said, there is no known author and that a recently signed economic agreement by which the parties put an end to the judicial process.

The agreement was signed on July 20 between several unions, Metro de Madrid and the

Association of Victims of Asbestos (Avida)

to financially compensate the families of thirteen deceased workers and another seven affected.

After years of litigation, that agreement before the Justice determined the

payment of about 200,000 euros

both to the families of the deceased and those affected, and between

66,650 and 115,525 to the children

It provides that future victims will also be compensated and stipulates that Metro will desist from all existing procedures before the Social Jurisdiction.

After that agreement, last week the Prosecutor's Office requested the file of the case considering that there was a crime against the rights of the workers but "it is not possible to attribute it to those investigated or to any known person."

Metro de Madrid has recalled that the company is eliminating asbestos in all trains and facilities with a

planned investment of 170 million euros

, of which more than 62 have already been committed. Metro has tendered more than a hundred contracts since 2018 to carry out the removal of asbestos from trains and facilities.

This asbestos elimination plan, moreover, is agreed with the unions themselves, with whom it has been agreed to create a new Asbestos Commission, in which the six present in the company participate with powers to treat, develop, and, in their case, formulate and transfer proposals, and monitor aspects related to the presence of asbestos in the Metro.

Thus, it is expected that by 2028 all Metro facilities will be free of asbestos.
