An Arab girl sues her fiancé after his relationship with another woman

An (Arab) girl confirmed that she sacrificed her work for her fiancé, but he broke off the engagement on his part, and was linked to another girl, explaining that she left work when the management told them that there is no relationship between the employees, wondering if she is allowed to file a compensation case against her fiancé for the damages suffered?

This came as part of legal awareness sessions, presented by Legal Counsel, Dr. Youssef Al Sharif, through "Emirates Today", to shed light on the Personal Status Law and its new articles.

The questioner said that “a 29-year-old girl works in the UAE, and during her work she met a young man of the same nationality, who is 35 years old. their engagement.”

She added that the administration informed them that the work policy requires that there be no kinship between the workers, and accordingly, one of them must leave work after the warning period, and agreed with him to leave the work, after he convinced her that it was better for him to stay at work, “considering that he is obligated to spend on me after Marriage, and that his salary is higher than mine, and his job situation is better, and he asked me to look for another job.”

She indicated that "she left her job and joined a second employer, with a better salary and a better situation, and the engagement lasted for a year and six months, and they were working to improve their situation, and then they traveled to their country to get married and spend their honeymoon."

And she continued, "During a year and a half, her fiancé used to frequent her apartment, and entered and left as if he were the owner of the house, and no illicit relationship occurred between them, because she fears God."

She pointed out that "the problems developed between them and escalated with the passing of the days, until one day I was surprised by her fiancé ringing the doorbell, accompanied by a girl, and told her that she was his new fiancée, and that their relationship had ended, and everything that happened between them was as if it was not, and it was a great shock for her, and she felt oppressed and sad. And I later learned that he had met this girl through work, and had promised her to marry her from her family, but she had stipulated that he break his engagement first.

The girl asks what are the legal procedures to file a lawsuit against her fiancé, obligating him to pay the material and moral damages she sustained, whether from leaving work, or breaking off her engagement in this way, and tarnishing her reputation in front of neighbors?

For his part, Dr. Youssef Al-Sharif said that the engagement does not allow the suitor to enter his fiancée’s house without the presence of her family, and the questioner erred in allowing him to do so, despite the absence of an existing legal relationship, and this behavior is not acceptable in most Arab countries.

As for the damages incurred by the girl, Al-Sharif said that the UAE law permits compensation for the victim of the annulment of the engagement by claiming compensation, but it is required to achieve this on the basis.

He added that the material damage is represented in the girl leaving her job, but this matter in fact was not harmed by it, but on the contrary she benefited, because she got a new job with a better position and a better salary.

As for moral or moral damage, the questioner was harmed by her fiancé’s reluctance to visit her house, and her reputation was polluted. Or was his actions a cause of embarrassment in front of people.

This is what was stipulated in Article (18/1) of the Personal Status Law, which said: “Each of the two parties may abandon the engagement, and if harm results from one of the parties’ unnecessarily reversing the engagement, the other party may claim compensation for the damage he sustained, and the cause of the abandonment shall be taken. Just judgment.” If the girl is able to prove the elements of the damage, the court will estimate the amount of compensation for the moral damage for her, and rule it for her.

The girl was shocked by her fiancé's behavior after she "sacrificed a lot for him".
