This came as part of legal awareness sessions presented by Legal Counsel, Dr. Youssef Al Sharif, through "Emirates Today", to shed light on the Personal Status Law and its new legal articles.

The questioner said that he married a woman of the same nationality, and had five children with her, of different ages and enrolled in schools and universities, but his emotional whims pushed him to marry another woman, which prompted the first to ask for a divorce, refusing to have a wife, so he divorced her calmly and understanding.

He added that he had two children from his second wife, a boy and a girl, and she would leave them with the maids, go out with her friends, stay up all night outside the house, come back late and sleep all day, and know nothing about her two children, and he no longer sees the woman he married in order to entertain him. Only a few minutes a day, and when he talks to her, she screams at him and says to him, "I want to live my life, and you want to lock me up in the house, I am not under your command and service, and this is my way of life. If you don't like it, divorce me and I will take revenge on you."

The questioner said that “with the development of problems with his second wife, he withheld her personal alimony, to force her to modify her behavior, but she did not pay attention to him, and she remained the same, but went to the court, and filed a lawsuit against him demanding alimony, custody of the two children and their alimony, and she did not ask for a divorce, because she wanted To remain on his debt and continue to spend on it.”

The complainant asks about the legal procedures to end his relationship with his second wife and recover the money she obtained from him, and whether he is divorcing her directly or filing a divorce case for damages.

Dr. Youssef Al-Sharif warned against rushing to marry another woman just to meet an emotional whim that quickly disappears, but its effects are long and affect the family entity and stress the reunification of children, noting the position of the first wife in her classy dealings and her quiet withdrawal from the life of the questioner and the request for divorce because she does not want to continue after her husband’s marriage, He described this type of divorce, as a merciful divorce.

He stated that the questioner can file a divorce suit for damages to prove that he discovered that his second wife, married him for his money, and neglected the care of her children and family, noting that the first legal procedure is to go to family guidance and then file a lawsuit.
