• LOC Shakira and Piqué, Miami and Barcelona: the stumbling block of the custody of their children

It seems that Shakira

's last days

as a resident of Barcelona are linked to intense judicial activity.

On the one hand, her separation procedures with FC Barcelona defender

Gerard Piqué,

with whom the Colombian singer has two children in common.

Although they were not married, the two have hired matrimonial lawyers to close an agreement on the custody of the children that they must then endorse in a family court.

The decision will not be easy since while the defender does not want to be far from the minors, the singer wants to move her residence to Miami to continue her professional activity from there, since she considers that she has no link with the city when separating from Piqué, according to various sources.

However, Shakira's main stumbling block to change of scene is in the open judicial procedure that she has in the Investigating Court number 2 of Esplugues de Llobregat that prosecuted her for allegedly defrauding the Treasury more than 14 million euros in the years of 2012 , 2013 and 2014. Judicial sources have explained to this medium that in recent weeks the negotiations between the singer's lawyers with the Prosecutor's Office and the rest of the accusations have accelerated to reach an agreement.

A month ago, the Barcelona Court rejected the singer's appeal against the court's decision to prosecute her for various crimes and left her one step away from the bench.

The Prosecutor's Office, which initiated the procedure by filing a complaint, was going to request a long prison sentence, which could exceed six years, in addition to a fine.

Precisely, the negotiation is to establish an amount as a sanction since at the beginning of the judicial procedure Shakira paid the 14.5 million owed to the Treasury.

The resolution of the Barcelona Court left Shakira on the ropes since it considered that after the investigation there were indications that the singer could commit these crimes considering that between 2012 and 2014, spending more than 183 days residing in Spain and that for that reason had to pay taxes before the Treasury as established by the regulations.

The Prosecutor's Office believes that the singer allegedly breached her tax obligations on personal income tax and her wealth tax by maintaining a corporate network to pay less taxes and that at that time she began her relationship with Piqué.

Any agreement goes through an acceptance by the singer of the commission of the crimes and the payment of the stipulated fine, which could be several million euros.

Although she may be sentenced to a prison sentence, possibly less than two years, she will not enter jail as she has no record and she will be suspended as long as she does not commit a crime in several years.

A court should endorse the agreement so the singer must go through a bench although it would be a procedure.

Thus, the artist would close this judicial ordeal that has lasted almost four years after the complaint filed by the Prosecutor's Office and accepted by the court.

From the beginning of her, the singer denied having committed any crime and assured that she had residence in the Bahamas in those years in addition to the fact that her tax advisors were in charge of the administration of her income as well as the payment of the corresponding taxes.

A few weeks ago, the singer changed her lawyers to defend her in this criminal proceeding at the risk of a trial and possible conviction.

That decision together with the end of her relationship with Piqué have changed the strategy in this procedure and the attempts to reach an agreement have intensified in recent weeks, with several meetings between all parties.

Now it is waiting for Shakira to close her legal affairs before starting a new stage away from Spain.
